TRADUCTIONS EN CONTEXTE

In order to ensure the enforcement of the obligations relating to pharmacovigilance introduced by Regulation (EU) No 1235/2010 and Directive 2010/84/EU, it is necessary to adapt Commission Regulation (EC) No 658/2007 of 14 June 2007 concerning financial penalties for infringement of certain obligations in connection with marketing authorisations granted under Regulation (EC) No 726/2004 of the European Parliament and of the Council so that any infringement of those obligations may be subject to the financial penalties provided for in Regulation (EC) No 658/2007.
Teneinde de uitvoering van bepaalde bij Verordening (EU) nr. 1235/2010 en Richtlijn 2010/84/EU ingestelde verplichtingen met betrekking tot geneesmiddelenbewaking te garanderen, is het noodzakelijk om Verordening (EG) nr. 658/2007 van de Commissie van 14 juni 2007 betreffende financiële sancties op de niet-nakoming van bepaalde verplichtingen in verband met vergunningen voor het in de handel brengen, verleend op grond van Verordening (EG) nr. 726/2004 van het Europees Parlement en de Raad aan te passen zodat bij niet-nakoming van deze verplichtingen de financiële sancties uit Verordening (EG) nr. 658/2007 kunnen worden opgelegd.

Since Regulation (EC) No 658/2007 concerns financial penalties for infringement of certain obligations in connection with marketing authorisations granted under Regulation (EC) No 726/2004, it is appropriate, for reasons of consistency, to include in the scope of Regulation (EC) No 658/2007 the obligations provided for in Regulation (EC) No 1901/2006 whose infringement may give rise to financial penalties under that same Regulation.

If the administering State adopts the procedure of conversion of the penalty, that State (a) will be bound by the findings as to the facts in so far as they appear explicitly or implicitly in the judgment handed down in the sentencing State; (b) may, unless it has made a declaration to the contrary, convert a custodial penalty into a financial penalty if the penalty is less than or equal to a period of six months; and (c) may not aggravate the penal position of the sentenced person and will not be bound by any minimum penalty which its own law may provide for the offence or offences committed (Article 8(5)).
