Where, despite the measures taken by the competent authority of the home Member State or because such measures prove inadequate, that regulated market or the MTF or OTF persists in acting in a manner that is clearly prejudicial to the interests of host Member State investors or the orderly functioning of markets, the competent authority of the host Member State shall, after informing the competent authority of the home Member State, take all the appropriate measures needed in order to protect investors and the proper functioning of the markets, which shall include the possibility of preventing that regulated market or the MTF or OTF from making their arrangements available to remote members or participants established in the host Member State.
Indien die gereglementeerde markt of de MTF of de OTF, in weerwil van de aldus door de lidstaat van herkomst getroffen maatregelen, of omdat deze maatregelen ontoereikend zijn, blijft handelen op een wijze die de belangen van beleggers in de lidstaat van ontvangst of het ordelijk functioneren van de markten kennelijk schaadt, neemt de bevoegde autoriteit van de lidstaat van ontvangst, na de bevoegde autoriteit van de lidstaat van herkomst daarvan in kennis te hebben gesteld, de nodige maatregelen om de beleggers en de goede werking van de markten te beschermen. Enabling statutory auditors and audit firms to provide statutory audits under their home-country professional titles in a host Member State addresses, in particular, the needs of groups of undertakings which, owing to the increasing trade flows resulting from the internal market, draw up financial statements in several Member States and are required to have them audited under Union law. The elimination of barriers to the development of statutory audit services between Member States would contribute to the integration of the Union audit market.

8. If despite the measures taken by the competent authorities of the home Member State of the AIFM or because such measures prove to be inadequate, or because the home Member State of the AIFM fails to act within a reasonable timeframe, the AIFM persists in acting in a manner that is clearly prejudicial to the interests of the investors of the relevant AIF, the financial stability or the integrity of the market in the host Member State of the AIFM, the competent authorities of the host Member State of the AIFM may, after informing the competent authorities of the home Member State of the AIFM, take all appropriate measures needed in order to protect the investors of the relevant AIF, the financial stability and the integrity of the market in the host Member State, including the possibility of preventing the AIFM concerned to further market the units or shares of the relevant AIF in the host Member State.
8. Indien de beleggingsonderneming, in weerwil van de aldus door de lidstaat van herkomst getroffen maatregelen, of omdat deze maatregelen ontoereikend zijn, blijft handelen op een wijze die de belangen van beleggers in de lidstaat van ontvangst of de ordelijke werking van de markten kennelijk schaadt, neemt de bevoegde autoriteit van de lidstaat van ontvangst, na de bevoegde autoriteit van de lidstaat van herkomst daarvan in kennis te hebben gesteld, de nodige maatregelen om de beleggers en de goede werking van de markten te beschermen.

(11b) In order to avoid unnecessary burdens for certain market participants and to clarify who actually exercises influence over an issuer, there is no need for notification requirements of major holdings of shares or other financial instruments as determined under Article 11a that result in an entitlement to acquire shares with regard to market makers or custodians, or of holdings of shares or such financial instruments acquired solely for clearing and settlement purposes, within limits and guarantees to be applied throughout the European Union. The home Member State should be allowed to provide limited exemptions as regards holdings of shares in trading books of credit institutions and investment firms.
(11 ter) Ter vermijding van onnodige lasten voor bepaalde marktdeelnemers en teneinde te verduidelijken wie daadwerkelijk invloed uitoefent op een uitgevende instelling, zijn geen kennisgevingsvereisten noodzakelijk voor belangrijke deelnemingen in de vorm van aandelen of in artikel 11 bis bedoelde financiële instrumenten die het recht verlenen aandelen te verwerven, ten aanzien van marktmakers of bewaarnemers of voor deelnemingen in de vorm van aandelen of financiële instrumenten die uitsluitend met het oog op clearing en afwikkeling zijn verworven, binnen de limieten en waarborgen die in de gehele Europese Unie moeten worden gehanteerd. De lidstaat van herkomst moet beperkte vrijstellingen kunnen verlenen voor het houden van aandelen in handelsportefeuilles van kredietinstellingen en beleggingsondernemingen.

Whatever may be the policy of this Union in regard to an open market economy, those people who want to buy home-produced meat should be given the right to know it is home-produced. Farmers deserve to have a guarantee of that, and so should the consumers.
Wat het beleid van deze Unie ook mag zijn met het oog op de openmarkteconomie, mensen die vlees uit hun eigen land willen kopen, moeten het recht hebben te weten of het uit eigen land afkomstig is. Zowel boeren als consumenten hebben recht op zo’n garantie.
