Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The codes should be used, as required, for each substance specified, but it should be noted that not all fourth character codes are applicable to all substances. Identification of the psychoactive substance should be based on as many sources of information as possible. These include self-report data, analysis of blood and other body fluids, characteristic physical and psychological symptoms, clinical signs and behaviour, and other evidence such as a drug being in the patient's possession or reports from informed third parties. Many drug users take more than one type of psychoactive substance. The main diagnosis should be classified, whenever possible, according to the substance or class of substances that has caused or contributed most to the presenting clinical syndrome. Other diagnoses should be coded when other psychoactive substances have been taken in intoxicating amounts (common fourth character .0) or to the extent of causing harm (common fourth character .1), dependence (common fourth character .2) or other disorders (common fourth character .3-.9). Restrictions concerning specific principles and the rights of information, access to and rectification or erasure of personal data, the right to data portability, the right to object, decisions based on profiling, as well as the communication of a personal data breach to a data subject and certain related obligations of the controllers may be imposed by Union or Member State law, as far as necessary and proportionate in a democratic society to safeguard public security, including the protection of human life especially in response to natural or manmade disasters, the prevention, investigation and prosecution of criminal offences or the execution of criminal penalties, including the safeguarding against and the prevention of threats to public security, or of breaches of ethics for regulated professions, other important objectives of general public interest of the Union or of a Member State, in particular an important economic or financial interest of the Union or of a Member State, the keeping of public registers kept for reasons of general public interest, further processing of archived personal data to provide specific information related to the political behaviour under former totalitarian state regimes or the protection of the data subject or the rights and freedoms of others, including social protection, public health and humanitarian purposes.

Data controllers must also guarantee data subjects’ right to obtain the rectification, erasure or blocking of data the processing of which does not comply with the applicable data protection laws, for example because of the incomplete or inaccurate nature of the data.

However, the EDPS points out that these provisions do not exclude similar obligations arising from Regulation (EC) No 45/2001, such as the obligation to provide information to the data subject pursuant to Article 11 and in particular Article 12 — dealing with information to be supplied when the data have not been obtained from the data subject —, the obligation pursuant to Article 14 to rectify without delay inaccurate or incomplete personal data and the obligation pursuant to Article 17 to notify rectification or erasure of data — as in the case of de-listing — to third parties to whom data have been disclosed, unless this proves impossible or involves a disproportionate effort.

The protection of individuals with regard to the processing of personal data is governed by Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data (6), which is fully applicable to the processing of personal data for the purposes of this Regulation, in particular as regards the rights of data subjects to access, rectification, blocking and erasure of data and notification to third parties, which have not in consequence been further particularised in this Regulation.
De bescherming van natuurlijke personen in verband met de verwerking van persoonsgegevens is geregeld bij Verordening (EG) nr. 45/2001 van het Europees Parlement en de Raad van 18 december 2000 betreffende de bescherming van natuurlijke personen in verband met de verwerking van persoonsgegevens door de communautaire instellingen en organen en betreffende het vrije verkeer van die gegevens (6), welke verordening volledig van toepassing is op de verwerking van persoonsgegevens voor de doeleinden van de onderhavige verordening, in het bijzonder ten aanzien van de rechten van de betrokkenen op het gebied van de toegang tot en de rectificatie, afscherming en wissing van gegevens en de kennisgeving van deze laatste handelingen aan derden, welke rechten derhalve niet nader zijn uitgewerkt in de onderhavige verordening.

5. Rights of access, rectification, erasure and blocking of data: as provided for in Article 12 of Directive 95/46/EC, the data subject must have a right of access to all data relating to him that are processed and, as appropriate, the right to the rectification, erasure or blocking of data the processing of which does not comply with the principles set out in this Appendix, in particular because the data are incomplete or inaccurate.
5. Recht van toegang, rectificatie, uitwissing en afscherming van gegevens: overeenkomstig artikel 12 van Richtlijn 95/46/EG moet de betrokkene recht hebben op toegang tot alle hem betreffende gegevens die worden verwerkt alsmede, waar van toepassing, op rectificatie, uitwissing of afscherming van gegevens waarvan de verwerking niet in overeenstemming met de in dit aanhangsel vermelde beginselen heeft plaatsgehad, met name wanneer de gegevens onvolledig of onjuist zijn.
