The Commission may decide not to start or pursue a conformity clearance inquiry in accordance with Article 52 of Regulation (EU) No 1306/2013 where it expects that the possible financial correction, for the non-compliance identified as a result of an inquiry referred to in paragraph 2 of Article 34, would not exceed EUR 50 000 and 2 % of the relevant expenditure or the amounts to be recovered.

In the cases referred to in points (a) and (b) of paragraph 2, where the participating insurance or reinsurance undertaking or the insurance holding company or mixed financial holding company which has its head office in the Union is either a related undertaking of, or is itself a regulated entity or a mixed financial holding company which is subject to supplementary supervision in accordance with Article 5(2) of Directive 2002/87/EC, the group supervisor may, after consulting the other supervisory authorities concerned, decide not to carry out the supervision of risk concentration referred to in Article 244 of this Directive, the supervision of intra-group transactions referred to in Article 245 of this Directive, or both, at the level of that participating insurance or reinsurance undertaking or that insurance holding company or mixed financial holding company.
3. In de in lid 2, onder a) of b), bedoelde gevallen, waarin de deelnemende verzekerings- of herverzekeringsonderneming of de verzekeringsholding of gemengde financiële holding met hoofdkantoor in de Unie hetzij een verbonden onderneming van een gereglementeerde entiteit of zelf een gereglementeerde entiteit is, of een gemengde financiële holding die overeenkomstig artikel 5, lid 2, van Richtlijn 2002/87/EG aan aanvullend toezicht is onderworpen, kan de groepstoezichthouder, na overleg met de andere betrokken toezichthoudende autoriteiten, besluiten het in artikel 244 van deze richtlijn bedoelde toezicht op de risicoconcentratie, het in artikel 245 van deze richtlijn bedoelde toezicht op intragroeptransacties, of beide, niet uit te oefenen op het niveau van deze deelnemende verzekerings- of herverzekeringsonderneming of deze verzekeringsholding of gemengde financiële holding.
