(2) This Regulation seeks to enhance trust in electronic transactions in the internal market by enabling secure and seamless electronic interactions to take place between businesses, citizens and public authorities, thereby increasing the effectiveness of public and private online services, electronic business and electronic commerce in the Union.

Consumers should be protected against unfair and misleading practices in line with Directive 2005/29/EC of the European Parliament and the Council of 11 May 2005 concerning unfair business-to-consumer commercial practices in the Internal Market as well as Directive 2000/31/EC of the European Parliament and the Council of 8 June 2000 on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market (Directive on electronic commerce) and Directive 2002/65/EC of the European Parliament and the Council of 23 September 2002 concerning the distance marketing of consumer financial services .

Calls for the creation of a favourable environment for service markets and for the development of small and medium-sized enterprises, including the social economy and the third sector, by promoting benchmark exercises in particular on the timing and the costs involved in setting up companies, simplified regulatory systems, business transactions by electronic commerce, fair tax competition and new emphasis on the promotion of risk capital and public/private partnership, which should not be hindered by inadequate competition rules;

Where Member States establish an opt-out register for such communications to legal persons, mostly business users, the provisions of Article 7 of Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of information society services, in particular electronic commerce, in the internal market (Directive on electronic commerce)(6) are fully applicable.
