An application to register a Community design may be submitted to the Office, the central industrial property office of a Member State or, in the Benelux countries which already have a common design, to the Benelux Design Office.

1. The Office and the central industrial property offices of the Member States and the Benelux Design Office shall, upon request, communicate to each other relevant information about the filing of applications for registered Community designs, Benelux designs or national registered designs and about proceedings relating to such applications and the designs registered as a result thereof.

Het Bureau, de centrale diensten voor de industriële eigendom van de lidstaten en het Benelux-Bureau voor tekeningen of modellen verstrekken elkaar op verzoek relevante gegevens over de indiening van aanvragen van ingeschreven Gemeenschaps-, Benelux- of ingeschreven nationale modellen en over procedures die op deze aanvragen betrekking hebben en de op grond daarvan ingeschreven modellen.

The date of filing of an application for a registered Community design shall be the date on which documents containing the information specified in Article 36(1) are filed with the Office by the applicant, or, if the application has been filed with the central industrial property office of a Member State or with the Benelux Design Office, with that office.

De datum van indiening van de aanvrage om een ingeschreven Gemeenschapsmodel is die waarop de aanvrager de stukken met de in artikel 36, lid 1, bedoelde gegevens voorlegt aan het Bureau of aan de centrale dienst voor de industriële eigendom van een lidstaat dan wel aan het Benelux-bureau voor tekeningen of modellen, indien de aanvrage daar wordt ingediend.

5. Where the date of receipt of an application for the registration of a Community design by the Office, by the central industrial property office of a Member State or by the Benelux Design Office is before the commencement of the three-month period specified in Article 111(3) of Regulation (EC) No 6/2002 the application shall be deemed not to have been filed.
5. Indien de datum van ontvangst van een aanvrage om inschrijving van een Gemeenschapsmodel bij het Bureau, bij de centrale dienst voor de industriële eigendom van een lidstaat of bij het Benelux-Bureau voor tekeningen of modellen vóór de aanvang van de in artikel 111, lid 3, van Verordening (EG) nr. 6/2002 genoemde termijn van drie maanden ligt, wordt de aanvrage geacht niet te zijn ingediend.

2. By derogation from paragraph 1, the date of filing of an application filed with the central industrial property office of a Member State or with the Benelux Design Office and reaching the Office more than two months after the date on which documents containing the information specified in Article 36(1) have been filed shall be the date of receipt of such documents by the Office.
2. In afwijking van lid 1 geldt als datum van indiening van een aanvrage die bij de centrale dienst voor de industriële eigendom van een lidstaat of bij het Benelux-bureau voor tekeningen of modellen is ingediend en die het Bureau meer dan twee maanden na de datum van indiening van de stukken met de in artikel 36, lid 1, genoemde informatie bereikt, de datum van ontvangst van die stukken door het Bureau.

2. Where the application is filed at the central industrial property office of a Member State or at the Benelux Design Office, that office shall take all steps to forward the application to the Office within two weeks after filing.
2. Wanneer de aanvrage bij de centrale dienst voor de industriële eigendom van een lidstaat of bij het Benelux-bureau voor tekeningen of modellen wordt ingediend, zorgen deze instanties ervoor dat de aanvrage binnen twee weken na de indiening aan het Bureau wordt doorgezonden.

3. As soon as the Office has received an application which has been forwarded by a central industrial property office of a Member State or by the Benelux Design Office, it shall inform the applicant accordingly, indicating the date of its receipt at the Office.
3. Zodra het Bureau een door de centrale dienst voor de industriële eigendom van een lidstaat of door het Benelux-bureau voor tekeningen of modellen doorgezonden aanvrage ontvangt, stelt het de aanvrager hiervan in kennis met vermelding van de datum waarop de aanvrage door het Bureau is ontvangen.
