Welcomes the European Citizens’ Initiative (ECI) – as defined in Article 11(4) of the Treaty on European Union (TEU) and Article 24(1) of the Treaty on the Functioning of the European Union (TFEU) – as the first instrument for transnational participatory democracy enabling citizens to engage directly with the EU institutions and to become actively involved in the framing of European policies and legislation, complementing their right to submit petitions to Parliament and to appeal to the European Ombudsman;

Reiterates the importance of the European Citizens’ Initiative (ECI), as a new citizens’ right introduced by the Lisbon Treaty which aims at increasing participatory democracy in the EU; notes the importance of the ECI as a powerful tool providing European citizens with a direct democratic right to contribute to the decision-making process of the EU, in addition to European citizens’ right to submit petitions to the European Parliament (EP) and their right of appeal to the European Ombudsman;

Complaining to the European Ombudsman will not suspend the abovementioned appeal deadlines.

Where necessary, the Commission will inform the complainant of any possible alternative forms of redress, such as recourse to national courts, the European Ombudsman, a national ombudsman or any other national or international complaints procedure.

3. Decisions taken by the Board under Article 8 of Regulation (EC) No 1049/2001 may be the subject of a complaint to the European Ombudsman or of proceedings before the Court of Justice, following an appeal to the Appeal Panel, referred to in Article 85 of this Regulation, as appropriate, under the conditions laid down in Articles 228 and 263 TFEU respectively.
3. Tegen de besluiten van de afwikkelingsraad krachtens artikel 8 van Verordening (EG) nr. 1049/2001 kan een klacht worden ingediend bij de Europese Ombudsman of beroep worden ingesteld bij het Hof van Justitie, desgevallend na een beroep bij het in artikel 85 van deze verordening bedoelde beroepspanel, onder de voorwaarden die in respectievelijk artikel 228 en artikel 263 VWEU zijn opgenomen.
