Eurocontrol has been mandated in accordance with Article 8(1) of Regulation (EC) No 549/2004 of the European Parliament and the Council of 10 March 2004 laying down the framework for the creation of the single European sky to assist the Commission in the development of implementing rules which lay down appropriate provisions on rules of the air based upon ICAO Standards and recommended practices, and harmonise the application of the ICAO airspace classification.
Overeenkomstig artikel 8, lid 1, van Verordening (EG) nr. 549/2004 van het Europees Parlement en de Raad van 10 maart 2004 tot vaststelling van het kader voor de totstandbrenging van het gemeenschappelijk Europees luchtruim , heeft Eurocontrol een mandaat gekregen om de Commissie bij te staan bij de opstelling van uitvoeringsregels waarin passende bepalingen inzake luchtverkeersregels zijn vastgesteld, gebaseerd op normen en aanbevolen werkwijzen van de ICAO, en om de toepassing van de ICAO-luchtruimclassificatie te harmoniseren.

The existing process for amending ICAO Standards and recommended practices within the framework of the Chicago Convention is not addressed by this Regulation.
Het bestaande proces voor het wijzigen van normen en aanbevolen werkwijzen van de ICAO in het kader van het Verdrag van Chicago wordt niet behandeld in deze verordening.

Pursuant to Regulation (EC) No 551/2004 and Regulation (EC) No 216/2008, the Commission is required to adopt implementing rules in order to adopt appropriate provisions on rules of the air based upon Standards and recommended practices of the International Civil Aviation Organisation (ICAO), and to harmonise the application of the ICAO airspace classification, with the aim to ensure the seamless provision of safe and efficient air traffic services within the single European sky.
Krachtens Verordening (EG) nr. 551/2004 en Verordening (EG) nr. 216/2008 moet de Commissie uitvoeringsbepalingen aannemen om passende bepalingen inzake luchtverkeersregels vast te stellen, gebaseerd op normen en aanbevolen werkwijzen van de Internationale Burgerluchtvaartorganisatie (de ICAO), en moet zij de toepassing van de ICAO-luchtruimclassificatie harmoniseren, teneinde de naadloze verlening van veilige en efficiënte luchtverkeersdiensten in het gemeenschappelijk Europees luchtruim te garanderen.

In order to ensure a smooth transition and a high level of civil aviation safety in the Union, the Implementing Rules should reflect the state of the art and the best practices in the field of aerodromes; take into account the applicable International Civil Aviation Organization (hereinafter referred to as ‘ICAO’) Standards and Recommended Practices, thereby respecting ICAO’s respective classification throughout the system of rules; and worldwide aerodrome operation experience, and scientific and technical progress in the field of aerodromes; be proportionate to the size, traffic, category and complexity of the aerodrome and nature and volume of operations thereon; provide for the necessary flexibility for customised compliance; and cater for the cases of aerodrome infrastructure which has been developed, prior to the entry into force of this Regulation, in accordance with the different requirements contained in the national legislations of the Member States.

For the other parts, baseline standards are the Standards and Recommended Practices (SARPs) of Annex 17 to the Convention on International Civil Aviation and the guidance material contained in the ICAO Aviation Security Manual (Doc 8973-Restricted).

(g)“Guidelines” means a set of explanations of the provisions of the General Annex, specific annexes and chapters therein which indicate some of the possible courses of action to be followed in applying the standards, transitional standards and recommended practices, and in particular describing best practices and recommending examples of greater facilities.

Each Contracting Party undertakes to promote the simplification and harmonisation of customs procedures and, to that end, to conform, in accordance with the provisions of this Convention, to the standards, transitional standards and recommended practices in the annexes to this Convention.
