49. Welcomes the proposal for a Council regulation on the establishment of the European Public Prosecutor’s Office (COM(2013)0354); firmly believes that establishing the European Public Prosecutor’s Office would represent an important step in further developing an EU area of freedom, security and justice; takes the view that, should the establishment of the European Public Prosecutor’s Office prove a success, the Council should, in the future, consider making use of Article 86(4) TFEU to extend the powers of that office to include serious crime having a cross-border dimension; welcomes, further, the proposal for a regulation on the European Union Agency for Criminal Justice Cooperation (Eurojust) (COM(2013)0535);
49. verwelkomt het voorstel voor een verordening van de Raad tot instelling van het Europees Openbaar Ministerie (COM(2013)0534); is er ten stelligste van overtuigd dat de oprichting van het Europees Openbaar Ministerie een belangrijke stap zou betekenen in de verdere ontwikkeling van een EU-ruimte van vrijheid, veiligheid en recht; is van mening dat de Raad, indien de oprichting van het Europees Openbaar Ministerie een succes blijkt, moet overwegen om in de toekomst gebruik te maken van artikel 86, lid 4, van het VWEU om de bevoegdheden van dat ministerie uit te breiden tot ernstige misdrijven met een grensoverschrijdende dimensie; is eveneens ingenomen met het voorstel voor een verordening betreffende het EU-Agentschap voor justitiële samenwerking in strafzaken (Eurojust) (COM(2013)0535);

all the activities of the European Public Prosecutor’s Office should ensure a high protection of the rights of defence, particularly considering that the Union could become an area in which the European Public Prosecutor’s Office could act, at operating speed, without having to resort to instruments of mutual legal assistance; in this regard, the respect of EU minimum standards in the field of the rights of individuals in criminal procedure in all Member States is a key element for the adequate functioning of the EPPO. It should be noted in this respect that the Roadmap for strengthening procedural rights of suspected or accused persons in criminal proceedings, adopted by the Council on 30 November 2009, has not yet been completed and that the proposal merely refers to the national legal systems for all issues relating to the right to remain silent, the presumption of innocence, the right to legal aid and to investigations for the defence; therefore, to respect the principle of equality of arms, the law applicable to the suspects or accused persons involved in the proceedings of the European Public Prosecutor’s Office should also apply to the procedural safeguards against the latter’s investigative or prosecutorial acts, without prejudice to any additional or higher standards of procedural safeguards granted by Union law;
bij alle activiteiten van het Europees Openbaar Ministerie dient het recht op verdediging volledig te worden beschermd, met name aangezien de Unie een ruimte zou kunnen worden waarbinnen het Europees Openbaar Ministerie op dienstsnelheid zou kunnen optreden, zonder haar toevlucht te hoeven nemen tot instrumenten voor wederzijdse rechtshulp; in dit opzicht is het van wezenlijk belang voor de adequate werking van het Europees Openbaar Ministerie dat de EU-minimumnormen op het gebied van de rechten van personen in strafzaken in alle lidstaten worden geëerbiedigd; Overigens is de routekaart ter versterking van de procedurele rechten van verdachten en beklaagden in strafprocedures, aangenomen door de Raad op 30 november 2009, nog niet voltooid en worden op grond van het voorstel alle kwesties op het gebied van het recht op zwijgen, onschuldpresumptie, het recht op gratis rechtsbijstand en onderzoek ter verdediging, naar nationaal niveau terugverwezen; de wetgeving die van toepassing is op de verdachten of beklaagden die betrokken zijn bij procedures van het Europees Openbaar Ministerie, dient met het oog op het beginsel van processuele gelijkheid eveneens van toepassing te zijn op de procedurele waarborgen tegen de opsporings- en vervolgingshandelingen van het Europees Openbaar Ministerie, zonder afbreuk te doen aan eventuele aanvullende of strengere normen betreffende procedurele waarborgen op grond van de wetgeving van de Unie;

In such mixed cases, where the offence affecting the Union’s financial interests is predominant , the competence of the European Public Prosecutor’s Office should be exercised after consultation with the competent authorities of the Member State concerned. Predominance should be established on the basis of criteria such as the offences’ financial impact for the Union, for national budgets, the number of victims or other circumstances related to the offences’ gravity, or the applicable penalties.
Wanneer in dergelijke gemengde gevallen het strafbare feit dat de financiële belangen van de Unie schaadt, de overhand heeft , dient het Europees Openbaar Ministerie zijn bevoegdheid uit te oefenen na raadpleging van de bevoegde autoriteiten van de betrokken lidstaat.Dit laatste dient te worden vastgesteld op basis van criteria zoals de financiële gevolgen van het strafbare feit voor de Unie, voor nationale begrotingen, het aantal slachtoffers of andere omstandigheden die verband houden met de ernst van het feit, of de toepasselijke sancties.

1. Where the case is not dismissed and it would serve the purpose of proper administration of justice, the European Public Prosecutor’s Office may, after the damage has been compensated, propose to the suspected person to pay a lump-sum fine which, once paid, entails the final dismissal of the case (transaction). If the suspected person agrees, he/she shall pay the lump sum fine to the Union.

Wanneer de zaak niet wordt geseponeerd en het in het belang van een goede rechtsbedeling is, kan het Europees Openbaar Ministerie, nadat de schade is vergoed, de verdachte een forfaitaire geldboete voorstellen waarmee de zaak definitief wordt afgehandeld (schikking). Indien de verdachte hiermee instemt, betaalt hij de geldboete aan de Unie.
