Reiterates the importance of public services and the need to respect the competences of LRAs as provided in the Treaties and Protocol 26 thereto, as well as in the provisions on domestic regulation and public procurement; emphasises that their prerogative of creating new public services in the future should also be respected; welcomes, therefore, the fact that the Commission has stated publically and repeatedly that it will exclude public services from the TiSA negotiations and calls, therefore, on the Commission to ensure that existing and new Services of General Interest, including Services of General Economic Interest, remain outside the scope of application of TiSA in order to ensure that national and – if applicable – local and regional authorities retain the full right to introduce, adopt, maintain or repeal any measures with regard to the commissioning, organisation, funding and provision of public services as provided in the Treaties; believes, furthermore, that there is a need to regulate the movement of professional service providers;
7. benadrukt opnieuw het belang van openbare diensten en de noodzaak om, in overeenstemming met de Verdragen, Protocol nr. 26 bij het VWEU en de bepalingen inzake nationale wetgeving en overheidsopdrachten, de bevoegdheden van de LRA's te eerbiedigen; beklemtoont dat het voorrecht van LRA's om in de toekomst nieuwe openbare diensten te creëren, eveneens moeten worden geëerbiedigd. is daarom verheugd dat de Commissie herhaaldelijk in het openbaar heeft verklaard dat zij openbare diensten zal uitsluiten van de TiSA-onderhandelingen, en roept de Commissie derhalve op de huidige en toekomstige diensten van algemeen belang – waaronder de diensten van algemeen economisch belang – uit te sluiten van het toepassingsgebied van TiSA, om te waarborgen dat nationale en, waar van toepassing, lokale en regionale autoriteiten het volledige recht behouden om maatregelen betreffende het doen verrichten, de organisatie, de financiering en de verlening van openbare diensten, zoals bepaald in de Verdragen, in te voeren, goed te keuren, te handhaven en in te trekken; is voorts van mening dat het verkeer van professionele aanbieders van diensten moet worden gereguleerd;

(xiii) to ensure an explicit exclusion of public services, as referred to in Article 14 TFEU, from the scope of application of TTIP, in order to ensure that national and local authorities have the freedom to introduce, adopt, maintain or repeal any measure with regard to the commissioning, organisation, funding and provision of public services, as provided for in Article 168 TFEU (public health) and Protocol 26 (Service of General Interest) thereto; this exclusion should apply whether the services in question are organised as a monopoly, operating under exclusive rights or otherwise, and whether publicly or privately funded and/or provided; such services include health and social care services, social security systems, publicly funded education, railway and public transport, and water, gas and electricity services;

Stresses that a professional public administration is instrumental in the successful implementation of all other reforms; therefore welcomes the fact that the Civil Service Law has started to be implemented, and calls for its proper implementation to be pursued in order to enhance administrative capacities, depoliticise public administration and fight corruption in the civil service, to strengthen meritocracy in appointments, promotions and dismissals, to increase the efficiency, transparency, accountability, professionalism and financial sustainability of the civil service, and to enhance good governance at all levels; calls for a strengthening of human resources management, an evaluation system for civil servants and independent monitoring of the implementation of civil service legislation; encourages the finalisation of a comprehensive public administration reform strategy and the continued promotion of depolarisation and knowledge of EU law and decision-making processes; stresses the need to enhance public integrity, to improve public services and to manage public resources more effectively; calls for improved public access to services and information; welcomes in this regard the new law on access to information; calls for a strengthening of the institution of the Ombudsman by giving appropriate follow-up to its findings and recommendations;

Public service contracts": public contracts having as their object the provision of services referred to in Annex I; a public contract relating to both the supply of goods and the provision of services as referred to in Annex I shall be regarded as a public service contract if the value of the services to be provided exceeds that of the goods covered by the contract; a public contract for the services referred to in Annex I and including services referred to in Division 45 of the CPV which are provided in a secondary capacity in addition to the main performance shall be regarded as a public service contract;

(c) "publicly available telephone service" means a service available to the public for originating and receiving national and international calls and access to emergency services through a number or numbers in a national or international telephone numbering plan, and in addition may, where relevant, include one or more of the following services: the provision of operator assistance, directory enquiry services, directories, provision of public pay phones, provision of service under special terms, provision of special facilities for customers with disabilities or with special social needs and/or the provision of non-geographic services.

Accepts that "must-carry" rules remain justified in the digital broadcasting environment and that the regulatory framework must take full account of the need to ensure universal access to public service content; believes that this can be achieved through the use of "must-carry" rules on key networks and guarantees of access for public service content through other key distribution networks and facilities such as set-top boxes and receivers; believes that such content should be easily accessible and prominently displayed on navigators or guides, provided that such rules are proportionate and limited to those channels that that are covered by a public service broadcast remit such as that defined in the Protocol annexed to the EC Treaty on the system of public service broadcasting in the Member States and that operators subject to such rules, where deemed appropriate by Member States, receive reasonable remuneration, taking into account the non-profit nature of public service broadcasting and the value of these broadcast channels to operators; takes the view that, in the case of possible commercial activities of public broadcasters, general competition law must be applied and no cross-subsidies allowed, in order to ensure interoperability in the digital television market and in broadcasting content and services;

(22) Information society services should be supervised at the source of the activity, in order to ensure an effective protection of public interest objectives; to that end, it is necessary to ensure that the competent authority provides such protection not only for the citizens of its own country but for all Community citizens; in order to improve mutual trust between Member States, it is essential to state clearly this responsibility on the part of the Member State where the services originate; moreover, in order to effectively guarantee freedom to provide services and legal certainty for suppliers and recipients of services, such information society services should in principle be subject to the law of the Member State in which the service provider is established.
(22) Met het oog op een doeltreffende bescherming van de algemene belangen moet de controle op de diensten van de informatiemaatschappij bij de bron van de activiteit gebeuren. Daarom is het nodig te waarborgen dat de bevoegde autoriteiten deze bescherming niet alleen voor de burgers van hun eigen land bieden, maar voor alle burgers van de Gemeenschap. Ter verbetering van het wederzijds vertrouwen tussen de lidstaten is het onontbeerlijk deze verantwoordelijkheid van de lidstaat vanwaar de diensten stammen duidelijk te omschrijven. Met het oog op een doeltreffende waarborging van het vrije dienstenverkeer en van de rechtszekerheid voor de dienstverleners en de afnemers van de diensten, moeten deze diensten bovendien in beginsel aan het rechtsstelsel van de lidstaat waar de dienstverlener gevestigd is, worden onderworpen.
