Decision ECB/2010/15 of 21 September 2010 concerning the administration of EFSF loans to Member States whose currency is the euro (1) lays down provisions concerning the opening of a cash account with the European Central Bank (ECB) in the name of the European Financial Stability Facility (EFSF) for the operation of the loan facility agreements (hereinafter the ‘Loan Facility Agreements’) under the EFSF Framework Agreement, which entered into force on 4 August 2010 (hereinafter the ‘EFSF Framework Agreement’).
Besluit ECB/2010/2015 van 21 september 2010 betreffende het beheer van EFSF-leningen aan lidstaten die de euro hebben aangenomen (1) stipuleert bepalingen betreffende het openen van een kasrekening bij de Europese Centrale Bank (ECB) op naam van de European Financial Stability Facility (EFSF) voor het uitvoeren van de leningsovereenkomsten uit hoofde van de EFSF-kaderovereenkomst die op 4 augustus 2010 in werking trad.

In accordance with paragraph 2 of the Preamble and Article 2(1) of the amended EFSF Framework Agreement, the EFSF may grant loan disbursements, precautionary facilities, facilities to finance the recapitalisation of financial institutions in a euro area Member State (through loans to the governments of such Member States including non-programme countries), facilities for the purchase of bonds in the secondary markets or facilities for the purchase of bonds in the primary market (all such instruments representing ‘Financial Assistance’), to be provided through financial assistance facility agreements (hereinafter the ‘Financial Assistance Facility Agreements’).

Decision ECB/2010/31 of 20 December 2010 concerning the opening of accounts for the processing of payments in connection with EFSF loans to Member States whose currency is the euro (2) lays down provisions concerning the opening of cash accounts with the ECB in the name of the national central bank of the relevant borrower Member State for the operation of the Loan Facility Agreements under the EFSF Framework Agreement.
Besluit ECB/2010/31 van 20 december 2010 betreffende de opening van rekeningen voor het verwerken van betalingen in verband met EFSF-leningen aan lidstaten die de euro als munt hebben (2) stipuleert bepalingen betreffende de opening van kasrekeningen bij de ECB op naam van de nationale centrale bank van de betrokken lenende lidstaat voor het uitvoeren van de leningsovereenkomsten uit hoofde van de EFSF-kaderovereenkomst.

Pursuant to the EFSF Framework Agreement and in accordance with EFSF’s by-laws, EFSF is to provide financing in the form of loan facility agreements (hereinafter the ‘Loan Facility Agreements’) to Member States whose currency is the euro where such Member States are in financial difficulties and have entered into a memorandum of understanding with the European Commission containing policy conditionality.
Ingevolge de EFSF-kaderovereenkomst en overeenkomstig de EFSF-statuten, verschaft EFSF financiering in de vorm van leningsovereenkomsten (hierna de „Leningsovereenkomsten”) aan de lidstaten die de euro als munt hebben, wanneer die lidstaten in financiële problemen verkeren en een memorandum van overeenstemming hebben gesloten met de Commissie aangaande de beleidsvoorwaarden.

Article 3(5) of the EFSF Framework Agreement provides that the disbursement of the loan made available by EFSF to a Member State whose currency is the euro will be made through the accounts of EFSF and the relevant borrower Member State which have been opened with the ECB for the purpose of the Loan Facility Agreements.
Artikel 3, lid 5 van de EFSF-kaderovereenkomst bepaalt dat de uitbetaling van de lening die EFSF ter beschikking stelde aan een lidstaat die de euro als munt heeft, loopt via de bij de ECB voor de Leningsovereenkomsten geopende rekeningen van EFSF en de betrokken lenende lidstaat.
