By way of derogation from this Regulation, engines which have received an EU type-approval pursuant to the relevant legislation applicable on 5 October 2016, or which meet the requirements set out by the Central Commission for the Navigation of the Rhine (CCNR) and adopted as CCNR Stage II, in the framework of the Revised Convention for Rhine Navigation, may continue to be placed on the market until the dates for the placing on the market of engines set out in Annex III.
3. In afwijking van deze verordening kunnen motoren waarvoor krachtens de op 5 oktober 2016 geldende toepasselijke wetgeving EU-typegoedkeuring is verleend of die voldoen aan de voorschriften die zijn vastgesteld door de Centrale Commissie voor de Rijnvaart (CCR) en zijn aangenomen als CCR-Fase II in het kader van de Herziene Rijnvaartakte, blijven in de handel worden gebracht tot de in bijlage III genoemde data voor het in de handel brengen van motoren.

A dedicated Committee involving Member States of the EU and of the Central Commission for Navigation on the Rhine (CCNR), will associate the Commission and be open to the United Nations’ Economic Commission for Europe (UN/ECE), the River Commissions, as well as to key stakeholders, including the European social partners.

Today a skipper is faced with coexisting sets of rules stemming from the European or National legislator, from the Central Commission for Navigation on the Rhine (CCNR) or the Danube Commission[7].

Whereas such a possibility was previously excluded under the rules established by the Central Commission for Navigation on the Rhine (CCNR), this situation changed when the CCNR adopted a modification of the Mannheim Act (Additional Protocol 7, in force since December 2004), introducing a legal basis for navigation on the Rhine with certificates delivered by bodies other than the CCNR.

Finally, the institutional framework for inland navigation in Europe is fragmented, as it is currently administered under different regimes, at different levels and with overlapping regulatory activities (EC/EU, the Central Commission for Navigation on the Rhine, the Danube Commission, the United Nations Economic Commission for Europe and the European Conference of Ministers of Transport).

The Commission, assisted by a committee, is charged with this task of establishment and development and it takes account of measures adopted by the relevant international organisations such as the International Association for Navigation, the Central Commission for Navigation on the Rhine and the United Nations Economic Commission for Europe.
