The Bunkers Convention was adopted under the auspices of the International Maritime Organisation (IMO) to ensure adequate, prompt and effective compensation for those who suffer damage caused by spills of oil carried as fuel in ships’ bunkers.

By letter of 18 January 2002 the Council consulted Parliament, pursuant to Article 67(1) of the EC Treaty and Article 300 of the EC Treaty, on the proposal for a Council decision authorising the Member States to sign and ratify in the interest of the European Community the International Convention on Civil Liability for Bunker Oil Pollution Damage, 2001 (the Bunkers Convention) (COM(2001) 675 – 2001/0271(CNS)).
Bij schrijven van 18 januari 2002 verzocht de Raad, overeenkomstig 67, lid 1, van het EG‑Verdrag en artikel 300 van het EG-Verdrag, het Parlement om advies inzake het voorstel voor een beschikking van de Raad waarbij de lidstaten worden gemachtigd in het belang van de Europese Gemeenschap het Internationaal Verdrag inzake wettelijke aansprakelijkheid bij verontreinigingsschade als gevolg van olie uit scheepsbunkers te ondertekenen en te ratificeren (COM(2001) 675 - 2001/0271(CNS)).

As is customary practice in International Maritime Organisation (IMO) liability treaties, the Bunkers Convention can be ratified only by States and not communities of States (Article 12 of the Convention).
Overeenkomstig de gewoonte bij aansprakelijkheidsovereenkomsten van de Internationale Scheepvaartorganisatie (IMO) kan ook het Bunkers-Verdrag alleen worden geratificeerd door staten en niet door gemeenschappen van staten (art. 12 van het verdrag).

The current position is that neither the Member States individually (by virtue of Regulation (EC) No 44/2001) nor the Community (by virtue of the legal nature of the Bunkers Convention) are in a position to approve the Convention.
Thans is de situatie zo dat het verdrag noch door de lidstaten afzonderlijk (vanwege verordening nr. 44/2001/EG) noch door de Europese Gemeenschap kan worden goedgekeurd (als gevolg van de juridische aard ervan).
