TRADUCTIONS EN CONTEXTE

[1] This flows from the Mutsch judgment (case 137/84, ECR 1985 2681-2697) in which the Court of Justice held that a right to have court proceedings conducted in one's own language contributed significantly to the integration of the migrant worker in the Host State and thus constituted a "social advantage" within the meaning of Art. 7(2) of Regulation 1612/68.

(13a) In accordance with numerous rulings of the Court of Justice, derogations from the fundamental principle of free movement of workers based on Art 45(4) TFEU should be limited to posts involving direct or indirect exercise of powers conferred by public law and to duties designed to safeguard the general interest of the State.

However, two basic conditions need to be satisfied if they are to realise their full potential. Firstly, we need to encourage the mobility and attractiveness of cultural factors, such as the mobility of artists, cultural workers and works of art and, secondly, we need to ensure that specific funding and economic support policies are put in place in the cultural sector, such as access to funds via the European Investment Bank.

24. Requests that the Commission call on the Member States to support art education and creativity; calls on the Commission, in particular, to include in existing programmes – especially Erasmus, Comenius and MEDIA – specific measures for artists, art school students and teachers and young creative workers, providing for various forms of exchanges, tutoring, mobility and residencies;

20. Underlines the importance of retaining the right for the host Member States to determine the minimum wage pursuant to Art 3(1) of the Posting of Workers Directive but calls on those Member States that set minimum wage rates by collective agreement, to facilitate access to information on the levels of minimum wage by undertakings that intend to seek establishment in another Member State;
