As regards the applicant’s complaint that his views were heard after the Secretary-General had consulted the Quaestors, with the result that the latter were not able to take account of his comments, it must be recalled that, as consultation with the Quaestors does not bind the Secretary-General as regards his decision on the inference to be drawn from the absence of supporting documents, the fact that the applicant’s views were heard after the said consultation was not such as to infringe the rights of the defence.
124 En ce qui concerne le reproche du requérant selon lequel il a été entendu après la consultation par le secrétaire général des questeurs, de sorte que ces derniers n’ont pas pu tenir compte de ses remarques, il y a lieu de rappeler que, la consultation des questeurs ne liant pas le secrétaire général quant à sa décision sur les conséquences à tirer de l’absence de pièces justificatives, le fait que le requérant ait été entendu après ladite consultation n’a pas été de nature à violer les droits de la défense.

I should, however, also like to scotch the rumours that could be heard after the President of the Commission had made his speech, namely that if Commission officials were suspected of fraud the Commission wanted to take control of the internal investigations away from OLAF.

With regard to the breach of Article 27(2) of the Rules Governing the Payment of Expenses and Allowances, the applicant observes that, as a result of his letter of 21 April 2003 (see paragraph 43 above), in which he had pointed out that the Rules Governing the Payment of Expenses and Allowances had been incorrectly applied in his regard, and given that no agreement had been reached between the Secretary-General and himself, the matter should have been referred to the Quaestors in accordance with that article for them to take a decision after consulting the Secretary-General and, where appropriate, the President or the Bureau.

After the applicant’s lawyer had requested certain documents and explanations, some of which were provided to him by the Secretary-General in a letter of 16 April 2003, on 21 April 2003 the applicant brought an administrative action under Article 27(2) of the Rules Governing the Payment of Expenses and Allowances against the Secretary-General’s letter of 26 February 2003.

In exceptional cases, and on a proposal submitted by the Secretary-General after consulting the Quaestors, the Bureau may, in accordance with Article 73 of the Financial Regulation and its implementing rules, instruct the Secretary-General temporarily to suspend the payment of parliamentary allowances until the Member has repaid the sums improperly used.
