In view of the above, the Commission concluded that the repeal of the measures would in all likelihood result in a significant increase of Chinese dumped imports at prices undercutting the Union industry prices, and therefore further aggravating the injury suffered by the Union industry.

Even with the anti-dumping duties added (this is not the case if it concerns imports under the inward processing regime), the average price of these Chinese imports undercut the Union industry prices by 32 %.

On the basis of the above methodology the imports undercut the Union industry prices by an average of 44 %.

Whilst average Indian import prices suggest that these imports undercut the Union industry prices, this cannot be concluded with certainty as for valid price comparisons more precise data should be used and also the relevant future developments should be considered (see recitals (176)-(180)).

This is so due to the current level of export prices of the product under review from the country concerned to other third country markets, which undercuts the Union industry prices and also due to the existence of unused capacities of the manufacturing facilities of the exporting producers in the United States of America.

The investigation showed that the Union industry was forced to decrease its prices mainly due to the pressure of the dumped imports and not to the FIT cutbacks. This is indicated by the fact that the most significant decrease in the prices of the Union industry occurred in 2010 and 2011, before the major FIT cutbacks took place. Indeed, the increase in dumped imports from the PRC significantly undercutting the Union industry’s prices forced the Union industry to cut down their prices to increasingly low levels.

In any case had the Union industry not imported these volumes of biodiesel, trading companies in the Union would have imported them, undercut the Union industry and sold them on the Union market, as they already import from these countries for sale to the diesel refiners in competition with the Union industry.

The investigation showed, however, that despite the growth of the Union market between 2009 and 2011, the situation of the Union industry deteriorated as a result of the dumped imports from the PRC heavily undercutting the Union industry’s sales prices.

Nevertheless, it should be pointed out that the investigation showed that any alleged low level of the Union production was mainly justified by a low level of sales prices in the Union market which was largely affected by the surge of low-priced US dumped imports undercutting the Union producers’ prices, in particular during the IP.

Based on the above it is provisionally concluded that the low-priced dumped imports from the PRC, which entered the Union market in large and overall increasing volumes and which significantly undercut the Union industry prices throughout the period considered, are causing material injury to the Union industry.
