We had a decision of the trial court where, confronted with what looked like two conflicting approaches — and albeit the recommendation of Chief Justice Lamer — it came down on the Lunn series of cases and the Court Martial Appeal Court in Trépanier clearly said they did not agree.
La Cour de première instance s'est prononcée sur ce qui semblait être deux approches opposées et, malgré la recommandation du juge en chef Lamer s'est alignée sur la jurisprudence Lunn. Or, dans l'affaire Trépanier, la Cour d'appel de la cour martiale a signifié nettement son désaccord.
