If a party providing confidential information fails to show good cause for a confidential treatment request or does not furnish a non-confidential summary of it in the requested format and quality, the Commission may disregard such information unless it can be satisfactorily demonstrated from appropriate sources that the information is correct.

After examining the documents supplied by the Commission, the Tribunal decided, by order of 18 April 2013, to place the general guide on the file and to send the detailed guide back to the Commission, on the ground that, having read the guide the Tribunal did not consider that this was necessary for it to rule on the merits of the pleas put forward by the applicant in the present case; to agree to the Commission’s request for confidentiality regarding the marking profile, and to make communication to the applicant of the general guide and the non-confidential version of the marking profile subject to confidential treatment and to certain conditions.
Après avoir examiné les documents fournis par la Commission, le Tribunal a décidé, par ordonnance du 18 avril 2013, de verser au dossier le guide général, de renvoyer le guide détaillé à la Commission au motif que, après lecture, ce guide ne lui était pas apparu nécessaire pour se prononcer sur le bien-fondé des moyens soulevés par le requérant dans la présente affaire, d’accepter la demande de confidentialité de la Commission en ce qui concerne le profil de marquage et de soumettre la communication au requérant du guide général et de la version non confidentielle du profil de marquage à un traitement confidentiel sous conditions.

3. The agreed arrangements to be established by common accord with a view to preserving the confidentiality of the information, in the case of confidential information communicated by the Commission pursuant to point 3.2 of Annex II to the Framework Agreement, or in the case of classified information forwarded by the Council pursuant to Article 5(4) of the Interinstitutional Agreement, shall be deposited, together with the confidential information, at the secretariat of the parliamentary body/office-holder or at the CIU, as the case may be.
3. Les modalités convenues à établir de commun accord afin de préserver la confidentialité des informations, dans le cas d'informations confidentielles communiquées par la Commission sur la base du point 3.2 de l'annexe II de l'accord-cadre, ou, dans le cas d'informations classifiées transmises par le Conseil conformément à l'article 5, paragraphe 4, de l'accord interinstitutionnel, sont déposées, avec les informations confidentielles, auprès du secrétariat de l'organe parlementaire/de la personne mandatée ou de l'UIC, selon le cas.

3. In the case of confidential information communicated by the Commission pursuant to the Framework Agreement, the agreed arrangements within the meaning of point 3.2 of Annex 2 to the Framework Agreement (laid down by common accord and concerning addressees, consultation procedure, i.e. secure reading room and meetings in camera, or other matters) designed to preserve the confidentiality of the information shall be deposited together with the confidential information at the secretariat of the parliamentary body/office holder or at the CIS when the information is classified as ‘CONFIDENTIEL UE/EU CONFIDENTIAL’ or above.
3. Dans le cas d'informations confidentielles communiquées par la Commission conformément à l'accord-cadre, les modalités convenues au sens du point 3.2. de l'annexe II de l'accord-cadre (fixées d'un commun accord et concernant les destinataires, la procédure de consultation, c'est-à-dire une salle de lecture sécurisée et des réunions à huis clos, ou d'autres questions) prévues pour préserver la confidentialité des informations sont déposées, avec les informations confidentielles, auprès du secrétariat de l'organe/du titulaire d'un mandat au sein du Parlement européen ou du SIC lorsque les informations sont classifiées «CONFIDENTIEL UE/EU CONFIDENTIAL» ou au-delà.
