For the purpose of establishing, pursuant to the second subparagraph of Article 3(1)(a) of Regulation (EC) No 141/2000, that a medicinal product is intended for the diagnosis, prevention or treatment of a life-threatening, seriously debilitating or serious and chronic condition in the Community, and that without incentives it is unlikely that the marketing of the medicinal product in the Community would generate sufficient return to justify the necesary investment, the following specific rules shall apply and the appropriate documentation shall be provided in accordance with the guidance drawn up pursuant to Article 5(3) of Regulation (EC) No 141/2000:
En vue de démontrer, conformément à l'article 3, paragraphe 1, point a), deuxième alinéa, du règlement (CE) n° 141/2000, qu'un médicament est destiné au diagnostic, à la prévention ou au traitement dans la Communauté d'une affection mettant la vie en danger, très invalidante ou grave et chronique et qu'il est peu probable que, en l'absence de mesures d'incitation, la commercialisation de ce médicament dans la Communauté génère des bénéfices suffisants pour justifier l'investissement nécessaire, les règles spécifiques suivantes sont applicables et la documentation mentionnée ci-après est fournie conformément aux lignes directrices établies en application de l'article 5, paragraphe 3, du règlement (CE) n° 141/2000:

that it is intended for the diagnosis, prevention or treatment of a life-threatening, seriously debilitating or serious and chronic condition in the Community and that without incentives it is unlikely that the marketing of the medicinal product in the Community would generate sufficient return to justify the necessary investment;

(5) objective criteria for designation should be established; those criteria should be based on the prevalence of the condition for which diagnosis, prevention or treatment is sought; a prevalence of not more than five affected persons per 10 thousand is generally regarded as the appropriate threshold; medicinal products intended for a life-threatening, seriously debilitating or serious and chronic condition should be eligible even when the prevalence is higher than five per 10 thousand;
(5) il convient de définir des critères objectifs de désignation des médicaments orphelins et de fonder ces critères sur la prévalence de l'affection que l'on cherche à diagnostiquer, à prévenir ou à traiter; une prévalence ne dépassant pas cinq cas sur dix mille personnes est généralement considérée comme le seuil adéquat; les médicaments destinés au traitement d'une affection mettant la vie en danger, très invalidante ou grave et chronique doivent bénéficier des mesures d'incitation, même si la prévalence de l'affection est supérieure à cinq sur dix mille;

(35) if exceptional circumstances caused by imports or exports should give rise to or threaten serious disturbance likely to jeopardise attainment of the goals set out in Article 33 of the Treaty, it should be possible to apply appropriate measures in trade with third countries, while complying with the Community's international commitments;
(35) lorsque des circonstances exceptionnelles de perturbation ou de menace de perturbation grave, du fait des importations ou exportations, sont susceptibles de mettre en péril les objectifs fixés à l'article 33 du traité, il convient de prévoir la possibilité d'appliquer des mesures appropriées dans les échanges avec les pays tiers, dans le respect des engagements internationaux de la Communauté;
