Is of the opinion that the annual reports on arms exports are significant tools in advancing the transparency of arms trade; finds it regrettable, however, that only 21 Member States made full submissions for the 16th Annual Report; notes that full submission means data on the financial value of both arms export licences issued and actual exports, broken down by both destination and EU Military List category; notes that Greece has not provided any data and that Germany and the UK did not submit any data on actual arms exports, while France provided a total figure for arms exports which was not disaggregated; points out that these, with the exception of Greece, are the same countries that are the biggest exporters and shoulder major responsibility for the global impact of EU arms exports; calls on the remaining Member States to fulfil their obligation to submit an annual report and to provide data, for the 16th Annual Report retrospectively and for the forthcoming Annual Reports in due time;

N. whereas a recent escalation in tension has arisen between China and neighbouring countries in the South China Sea, including Vietnam, as a result of unilateral actions taken in contested areas in the South China Sea, which are not in line with international law; whereas the escalation of territorial disputes in the region has implications for global affairs and represents a serious threat to peace, security, stability and international trade; whereas resolving these tensions constitutes a major strategic interest for the EU, in view of maintaining global security as well as securing stability in major maritime routes in the South China Sea that are vital to EU trade; whereas Vietnam officially supports the legal submission by the Philippines to the Permanent Court of Arbitration (PCA) in The Hague of 16 March 2015 on the basis of the United Nations Convention on the Law of the Sea (UNCLOS);

Member States shall ensure that well operations or combined operations shall not be commenced or continued without submission of the report on major hazards for the installations involved and its acceptance pursuant to paragraph 3a of this Article. Furthermore, such operations shall not be commenced and continued without submission of a well notification or combined operation notification pursuant to Article 9 to the competent authority or if the competent authority expresses objections to the content of a notification.

Les États membres veillent à ce que des opérations sur puits ou des opérations combinées ne puissent pas commencer ou se poursuivre si le rapport sur les dangers majeurs portant sur les installations concernées n'a pas été soumis et accepté conformément au paragraphe 3 bis. With regard to information exchange systems, the rapporteur for the opinion welcomes in particular the opening up of SPIRS to the public, the setting of a maximum time limit of one year for the submission of information regarding major emergencies and the lowering of notification criteria from 5% to 1% of the qualifying quantity laid down in column 3 of Annex I. As a result of the lowering of notification criteria, the number of major accidents reported will increase; however, this will at the same time enable other operators to draw appropriate conclusions for the future and to learn from others' mistakes.
En ce qui concerne les systèmes d'échange d'informations, la rapporteure pour avis se félicite tout particulièrement de l'ouverture du système de recherche d'informations sur les installations SEVESO (SPIRS) au public, de la fixation d'un délai maximal d'un an pour la transmission d'informations relatives aux accidents majeurs, et de l'abaissement des seuils nécessitant une notification de 5 % à 1 % de la quantité indiquée dans la colonne 3 de l'annexe I. Grâce à cet abaissement des seuils nécessitant une notification, le nombre d'accidents majeurs rapportés augmentera mais cela permettra en parallèle aux autres exploitants de tirer des enseignements pour l'avenir et d'apprendre des erreurs des autres.

On the basis of experience it is appropriate to apply the reduction of amounts subject to the automatic decommitment rule by the amounts concerned for a major project from the date of the submission to the Commission of the application for a major project that fulfils all the requirements of this Regulation.
L’expérience a montré qu’il conviendrait de réduire les montants soumis à la règle du dégagement d’office à hauteur des montants concernés pour un grand projet à partir de la date de soumission à la Commission de la demande pour un grand projet qui remplit toutes les exigences du présent règlement.

2. The Commission shall adopt a decision as soon as possible but no later than three months after the submission by the Member State or the managing authority of a major project, provided that the submission is in accordance with Article 40.
