I. whereas Recital 55 of Regulation (EU) No 1024/2013 specifies that any reporting obligations vis-à-vis Parliament should be subject to the relevant professional secrecy requirements; whereas Recital 74 and Article 27(1) of that Regulation provide that the members of the Supervisory Board, the steering committee, staff of the ECB and staff seconded by participating Member States carrying out supervisory duties shall be subject to the professional secrecy requirements set out in Article 37 of the Statute of the ESCB and in relevant acts of Union law; whereas Article 339 TFEU and Article 37 of the Statute of the ESCB establish that the members of the governing bodies and the staff of the ECB and the national central banks are bound by the obligation of professional secrecy;

As regards the grade in which a member of staff seconded from a Member State’s national diplomatic service is placed upon his appointment by an EU body as a member of its temporary staff, the functions previously performed by the person concerned as a seconded national expert within that same body cannot be taken into consideration for the purposes of comparison with the functions corresponding to the post occupied as a member of the temporary staff since, as a seconded national expert, he was not eligible for grading under the Staff Regulations.
S’agissant du classement en grade lors de la nomination comme agent temporaire par un organe de l’Union d’un membre détaché du personnel du service diplomatique national d’un État membre, les fonctions exercées préalablement par l’intéressé auprès du même organe en tant qu’expert national détaché ne sauraient être prises en considération aux fins d’une comparaison avec les fonctions correspondant au poste occupé comme agent temporaire car, en tant qu’expert national détaché, l’intéressé ne pouvait pas se prévaloir d’un classement en grade par application du statut.

It is clear from paragraph 1 of the first group of eligibility criteria contained in the vacancy notice that, according to Article 98 of the Staff Regulations, candidates must be officials of the General Secretariat of the Council of the European Union, of the Commission or of the EEAS, or temporary staff to whom Article 2(e) of the CEOS applies, that is to say, staff seconded from the national diplomatic services of the Member States engaged in order to occupy temporarily a permanent post within the EEAS, or staff from the national diplomatic services of the Member States.

Welcomes the fact that 583 of 611 available posts had been filled by the end of 2013 and that 144 contract agents, seconded national experts and employment agency staff were employed by the Agency; notes that the occupation rate has decreased compared to 2012 and that the proportion of contract staff, seconded national experts and employment agency staff has decreased compared to 2012; notes that the Agency is dedicating 81 % of its human resources to operational tasks and that this represents a slight increase compared to the situation in 2012; encourages the Agency to make further progress on this path;

13. Calls for the modernisation of the EU delegations network so as to reflect the needs of EU foreign policy in the 21st century, including by adapting staff numbers and expertise; considers, for example, that all delegations located in conflict areas, particularly in countries where a CSDP mission is in place, should include an expert on security and defence matters; asks the HR/VP to strengthen the authority of the head of delegation over all staff, irrespective of their institutional origin, and to simplify the administrative budgets of delegations towards a single funding source; demands that the reporting lines be clarified; regrets that the potential for synergies and economies of scale afforded by the strengthening of cooperation between Member State embassies and EU delegations has yet to be fully exploited; insists that the fair balance between staff seconded from Member States and EU officials laid down in the Council Decision of 26 July 2010 establishing the EEAS should be respected on all levels, and notes that, especially in higher positions such as that of Head of Delegation, this balance is currently not being maintained;
13. demande la modernisation du réseau des délégations de l'Union européenne afin qu'il corresponde aux besoins de la politique étrangère de l'Union au XXIe siècle, y compris en adaptant l'effectif et les connaissances du personnel; estime par exemple que toutes les délégations situées dans des zones de conflit, en particulier dans les pays où une mission de PSDC est en cours, devraient comprendre un expert des questions de sécurité et de défense; demande à la vice-présidente de la Commission et haute représentante de l'Union pour les affaires étrangères et la politique de sécurité de renforcer l'autorité du chef de délégation sur l'ensemble du personnel, quelle qu'en soit l'origine institutionnelle, et de simplifier les budgets administratifs des délégations afin qu'il y ait une source de financement unique; demande que les liens hiérarchiques soient clarifiés; déplore que les synergies et les économies d'échelle potentielles obtenues par le renforcement de la coopération entre les ambassades des États membres et les délégations de l'Union européenne ne soient pas encore pleinement exploitées; exige le respect total d'un juste équilibre entre les effectifs détachés des États membres et le nombre de fonctionnaires de l'Union européenne, ainsi que le prévoit la décision du Conseil du 26 juillet 2010 portant création du SEAE, et observe qu'actuellement, l'équilibre n'est pas respecté, en particulier aux plus hautes fonctions, comme celles de chef de délégation;

Subject to Articles 30 to 42, the rules laid down in the preceding chapters shall also apply to military staff seconded to the GSC in order to form the European Union Military Staff pursuant to Council Decision 2001/80/CFSP of 22 January 2001 on the establishment of the Military Staff of the European Union

Subject to Articles 24 to 33, these Rules shall also apply to military staff seconded to the GSC in order to form the European Union military staff pursuant to Council Decision 2001/80/CFSP of 22 January 2001 on the establishment of the military staff of the European Union(1).
