TRADUCTIONS EN CONTEXTE

As regards the action brought by the Council against the Commission (Case C-66/12), whereby the Council claimed that the Commission was in breach of the exception clause laid down by the Staff Regulations and of the EU and FEU Treaties by submitting a proposal based on the “adjustment method” and by thereby refusing to submit appropriate proposals on the basis of that clause, the Court holds that, in the light of the judgment delivered in Case C-63/12, that action is now devoid of purpose and, consequently, there is no need to adjudicate on it.
Quant au recours introduit par le Conseil contre la Commission (affaire C-66/12), par lequel le Conseil a fait valoir que la Commission avait violé la clause d’exception prévue par le statut ainsi que les traités UE et FUE en présentant une proposition sur la base de la « méthode d’adaptation » et en refusant, ainsi, de présenter des propositions appropriées sur le fondement de cette clause, la Cour constate que, eu égard à l’arrêt rendu dans l’affaire C-63/12, il est devenu sans objet et, partant, qu’il n’y a pas lieu de statuer sur celui-ci.

However, the Staff Regulations also provided for an exception clause whereby it was possible to set aside that “adjustment method” in order to be able to take into account an economic crisis when adjusting remuneration.
Toutefois, le statut prévoyait également une clause d’exception permettant d’écarter cette « méthode d’adaptation » afin de pouvoir tenir compte d’une crise économique dans le cadre de l’adaptation des rémunérations.

As regards the Commission's interpretation of the new Staff Regulations, whereby its power to limit the introduction of new measures because of their financial impact should also apply to any other measure involving people with disability, such as those regarding the education of children with special educational needs of EU officials, the Ombudsman considered that these provisions were solely confined to the recruitment of officials and not applicable to any other situation concerning the treatment of officials in connection with a situation of disability.
Concernant l'interprétation du nouveau Statut des fonctionnaires effectuée par la Commission, selon laquelle son pouvoir de limiter l'introduction de nouvelles mesures en raison de leur impact financier devrait également s'appliquer à toutes autres mesures en faveur des personnes handicapées, comme celles concernant l'éducation d'enfants à besoins éducatifs spéciaux de fonctionnaires de l'Union européenne, le Médiateur estimait que ces dispositions se limitaient au seul recrutement de fonctionnaires et n'étaient pas applicables à toute autre situation relative au traitement des fonctionnaires par rapport à une situation de handicap.

I. Annual Plans: submit, for the first time, a summary by Directorate-General of all completed and outstanding tasks for 2000, since annual work plans for each of the 29 Directorates-General and job descriptions of all 59 officials who occupy A1 posts were not established for 1999, or for any prior year; welcomes that under Action 22 of the White paper on Reform, the Commission would carry out individual performance appraisals of A1 and A2 officials in April 2001; regrets substantial delays whereby the first appraisal will only start by the end of 2001, as stated in the Commission decision of 22 December 2000 on the appraisal, selection and appointment of senior Commission officials (SEC(2000) 2305 ); calls for the transmission of annual work plans and, on a confidential basis, appraisals of A1 officials; asks the Commission to inform Parliament of the number of officials that have left under Articles 50 and 51 of the Staff Regulations; calls on the Commission to take into account the staff appraisals; invites the Commission to implement measures that will allow it to dismiss A1 officials whose career development reports indicate that performance is inadequate ;

Plans annuels: à présenter, pour la première fois, une synthèse par direction générale de toutes les tâches, achevées et en instance pour 2000, dès lors que les plans de travail annuels pour chacune des 29 directions générales et les descriptions des fonctions de tous les fonctionnaires - 59 - occupant des postes A1 n'ont pas été établis pour 1999, ni pour les exercices précédents; se félicite que dans le contexte de l'action 22 du Livre blanc sur la réforme, la Commission entendrait procéder à une évaluation individuelle du travail des fonctionnaires A1 et A2 en avril 2001; déplore les retards importants qui empêcheront la première évaluation de débuter avant la fin de 2001, comme le constate la décision de la Commission du 22 décembre 2000 relative à l'évaluation, la sélection et la nomination des hauts fonctionnaires de la Commission (SEC(2000)2305 ); demande la communication des plans de travail annuels et, sur une base confidentielle, des évaluations des fonctionnaires A1; invite la Commission à l'informer du nombre de fonctionnaires ayant cessé leurs activités sur la base des articles 50 et 51 du statut; invite la Commission à tenir compte des évaluations de personnel; invite la Commission à mettre en œuvre des mesures qui lui permettront de licencier les fonctionnaires dont les rapports de notation font apparaître des résultats insuffisants ;
