Notes that the former Executive Director of the Agency wrote to the Agency on 28 December 2010 outlining the activities which he was intending to take up at the end of his term of office; considers the first decision of 11 January 2011, taken by the Chairman of the Agency Management Board, to authorise the new activities of the former Executive Director of the Agency to be a breach of Union rules relating to conflicts of interest, in particular with regard to Title II, Article 16, of the Staff Regulations of the Officials of the European Communities; recalls that according to Title II, Article 11, and title IV, Article 91, of the Conditions of Employment of Other Servants of the European Communities, this provision applies by analogy to temporary agents and to contract employees; considers the fact that the Management Board adopted limitations on the future activities of the former Executive Director on 17 March 2011 - only after strong public protest - to be clear proof that the Agency did initially not apply the Staff Regulations properly, which in turn raises serious questions about their application of the rules in general; asks the Executive Director to present a detailed report on the implementation of Article 16 of the Staff Regulations within the Agency;

Indeed, the difference between, on the one hand, the conditions to be met for Community liability to arise for the harm caused to its officials and former officials owing to a breach of the provisions of the Staff Regulations and, on the other, the conditions governing Community liability towards third parties owing to a breach of other provisions of Community law is justified, in the light of the balance of rights and obligations which the Staff Regulations have specifically created in the relationships between the institutions and their officials, in order that European citizens may be assured that the tasks of general interest entrusted to the institutions are properly discharged.

Decisions to reassign officials in the interest of the service, taken on the basis of Article 7(1) of the Staff Regulations, have as their purpose the proper functioning of the service, even where they are justified by internal relationship difficulties, and therefore come within the broad discretion which the institutions have to organise their departments to suit the tasks entrusted to them and to assign the staff available to them in the light of such tasks, provided that such assignment conforms with the principle of assignment to an equivalent post.

(8b) In order to ensure a proper balance amongst the different staff components of the EEAS and in accordance with Council Decision 2010/427/EU, when the EEAS has reached its full capacity, personnel from the diplomatic services of the Member States appointed as temporary agents should represent at least one third of all EEAS staff at AD level and Union officials should represent at least 60% of all EEAS staff at AD level. This should include staff coming from the diplomatic services of the Member States who have become permanent officials of the Union in accordance with the provisions of the Staff Regulations.
(8 ter) Pour garantir un bon équilibre entre les différentes composantes du personnel du SEAE et conformément à la décision du Conseil n° 2010/427/UE, le personnel provenant des services diplomatiques des États membres employé en qualité d'agents temporaires devrait, une fois que le SEAE aura atteint sa pleine capacité, représenter au moins un tiers de l'ensemble des effectifs du SEAE de niveau AD et les fonctionnaires de l'Union au moins 60 % de l'ensemble des effectifs du SEAE de niveau AD. The fact that EEAS staff will be subject to the Staff Regulations, as far as officials of the EU are concerned, and the Conditions of employment, as far as staff coming from national diplomatic services, temporary agents and contract staff are concerned, entails the need, where appropriate, that the same amendment be tabled twice, once to ensure its proper reflection in the Staff Regulations, and hence its application to EU Officials, and once to ensure its proper reflection in the Conditions of Employment, and hence its application to EEAS staff coming from national diplomatic services, temporary agents and contract staff.

This Regulation should enter into force at the earliest possible date, since the amendments to the Staff Regulations and Conditions of Employment of Other Servants constitute a necessary condition for the proper functioning of the EEAS,

You will see that we are basically satisfied that this framework of Staff Regulations will deliver the core parts of the reform: the move to a personnel system where members of staff in all the European institutions will be properly compensated, will be able to exploit their talents and encouraged to progress their careers in a system that rewards their efforts.

It also means that responsibilities in the domain of security have to be based on proper legal provisions. The provisions in the Staff Regulations fully apply, notably its Article 17 on the obligation of staff to exercise discretion with regard to Commission information and its Title VI on disciplinary measures.
