IN-CONTEXT TRANSLATIONS

For the purposes of Article 29(1)(a) [of the Staff Regulations], when filling a vacant post in the EEAS, the Appointing Authority shall consider the applications of officials of the General Secretariat of the Council [of the European Union], the [European] Commission and the EEAS, of temporary staff to whom Article 2(e) of the Conditions of Employment of Other Servants [of the European Union] applies and of staff from national diplomatic services of the Member States without giving priority to any of those categories.
Aux fins de l’article 29, paragraphe 1, [sous] a), [du statut,] lors du pourvoi d’une vacance au SEAE, l’autorité investie du pouvoir de nomination examine les candidatures des fonctionnaires du secrétariat général du Conseil [de l’Union européenne], de la Commission [européenne] et du SEAE, des agents temporaires auxquels s’applique l’article 2, [sous] e), du régime applicable aux autres agents [de l’Union européenne] et des membres du personnel des services diplomatiques nationaux des États membres sans accorder la priorité à l’une ou l’autre de ces catégories.

3. In order to guarantee adequate representation of staff from national diplomatic services in the EEAS, the High Representative of the Union for Foreign Affairs and Security Policy and Vice-President of the Commission may decide that, by derogation from Article 98(1) of the Staff Regulations, priority may be given until 30 June 2013 for certain posts in function group AD in the EEAS to candidates from national diplomatic services of the Member States in case of substantially equal qualifications.
3. Afin de garantir une représentation appropriée du personnel des services diplomatiques nationaux au SEAE, le haut représentant de l'Union pour les affaires étrangères et la politique de sécurité et vice-président de la Commission peut décider que, par dérogation à l'article 98, paragraphe 1, du statut, la priorité peut être accordée jusqu'au 30 juin 2013, dans le cas de certains postes relevant du groupe de fonction AD à pourvoir au SEAE, aux candidats des services diplomatiques nationaux des États membres à niveau de qualification essentiellement égal.

3. In order to guarantee adequate representation of staff from national diplomatic services in the EEAS, the High Representative shall decide that, by way of derogation from Articles 29 and 98(1), first subparagraph, of the Staff Regulations, priority may be given until 30 June 2013 for certain posts in function group AD in the EEAS to candidates from national diplomatic services of the Member States in the case of equivalent qualifications.

6. In order to guarantee adequate representation of staff from national diplomatic services in the EEAS, the High Representative shall decide that, by way of derogation from Article 29 and from the first subparagraph of Article 98(1) of the Staff Regulations, priority may be given until 30 June 2013 for certain posts in the AD function group in the EEAS to candidates from national diplomatic services of the Member States in the case of equivalent qualifications.
6. Afin de garantir une représentation appropriée du personnel des services diplomatiques nationaux au SEAE, le haut représentant décide que, par dérogation à l’article 29 et à l’article 98, paragraphe 1, premier alinéa, du statut, la priorité peut être accordée jusqu’au 30 juin 2013, dans le cas de certains postes relevant du groupe de fonctions AD à pourvoir au SEAE, aux candidats des services diplomatiques nationaux des États membres pour des niveaux de qualification équivalents.

(8a) In addition, with a view to helping reach the target that staff from national diplomatic services should represent at least one third of all EEAS staff at AD level, it is necessary to provide for a temporary derogation until 30 June 2013 from Article 98(1) of the Staff Regulations enabling the High Representative to give priority for certain posts in function group AD in the EEAS to candidates from such national diplomatic services in the case of equivalent qualifications.
(8 bis) En outre, en vue de contribuer à atteindre l'objectif selon lequel le personnel provenant des services diplomatiques nationaux devrait représenter au moins un tiers de l'ensemble du personnel du SEAE de niveau AD, il est nécessaire de prévoir une dérogation temporaire, jusqu'au 30 juin 2013, à l'article 98, paragraphe 1, du statut, pour permettre au haut représentant de donner la priorité, pour certains postes du groupe de fonctions AD au sein du SEAE, à des candidats de ces services diplomatiques nationaux, à niveau de qualification équivalent.

Article 98(1), second subparagraph of the Staff Regulations will read as follows : “As from 1 July 2013, the Appointing Authority shall also consider the applications of officials from other institutions without giving priority to any of these categories”.

In addition, with a view to attaining the objective that staff from national diplomatic services should represent at least one third of all EEAS staff at AD level, it is necessary to provide for a temporary derogation until 30 June 2013 from Article 98(1) of the Staff Regulations enabling the High Representative to give priority for certain posts in function group AD in the EEAS to candidates from such national diplomatic services in the case of equivalent qualifications.

11. Accepts the commitment given by the Commission to define the staff and structures needed on the basis of objectives ranked in order of priority, but calls on the Commission to state clearly in its reform programme all its priorities and the criteria for the selection of the resources to be assigned thereto (staff employed pursuant to the Staff Regulations; external resources), on the basis of a system which can combine activity-based budgeting with an integrated resource-management system;
11. accepte l'engagement assumé par la Commission de définir les besoins en personnels et en structures sur la base d'objectifs classés selon un ordre de priorité, mais demande à la Commission de préciser clairement dans son programme de réforme toutes ses priorités ainsi que les critères de choix des ressources qui y seront affectées (personnel statutaire; moyens externes), sur la base d'un système qui puisse combiner un Activity Based Budgeting avec un système de gestion intégrée des ressources;

Whereas, in the light of experience gained and the development of certain tasks of officials of the European Communities, it seems appropriate, as a matter of priority, to amend certain provisions of the Staff Regulations of officials of the European Communities, laid down in Regulation (EEC, Euratom, ECSC) No 259/68 (2), as last amended by Regulation (Euratom, ECSC, EEC) No 711/75 (3),
considérant qu'il est apparu opportun, à la lumière de l'expérience acquise et compte tenu de l'évolution de certaines tâches des fonctionnaires des Communautés européennes, de procéder par priorité à une modification de certaines dispositions du statut des fonctionnaires des Communautés européennes fixé par le règlement (CEE, Euratom, CECA) nº 259/68 (2) et modifié en dernier lieu par le règlement (Euratom, CECA, CEE) nº 711/75 (3),

Whereas in the light of experience and taking into account the difficulties encountered in the application of the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Communities laid down in Regulation (EEC, Euratom, ECSC) No 259/68,2 as amended by Regulation (Euratom, ECSC, EEC) No 2278/69,3 it seems appropriate to amend, as a priority, certain provisions of the Staff Regulations to take account of certain services of a special nature provided by officials and servants paid from appropriations in the research and investment budget and employed in establishments of the Joint Research Centre or on indirect action;
considérant qu'il est apparu opportun, à la lumière de l'expérience acquise et compte tenu des difficultés rencontrées lors de l'application du statut des fonctionnaires des Communautés européennes ainsi que du régime applicable aux autres agents de ces Communautés, fixés par le règlement (CEE, Euratom, CECA) nº 259/68 (2) et modifiés par le règlement (Euratom, CECA, CEE) nº 2278/69 (3), de procéder par priorité à une modification de certaines dispositions du statut pour tenir compte du caractère particulier de certaines prestations de service des fonctionnaires et agents rémunérés sur les crédits de recherches et d'investissement et affectés aux établissements du Centre commun de recherches ou aux actions indirectes,
