An acquaintanceship between a member of a selection board and a candidate is not in itself sufficient to prove that that member has a personal interest, within the meaning of Article 11a of the Staff Regulations, capable of calling his impartiality into question.

Thus, neither the fact that, in its decision ruling on an administrative complaint, an institution or agency responded to the substantive arguments put forward without touching on the possibility that the complaint had been submitted out of time and was therefore inadmissible nor the fact that that institution or agency expressly informed the person concerned that he had the option of contesting that decision before the courts has any effect on the Civil Service Tribunal’s assessment of whether the action subsequently brought against that decision is inadmissible: facts of that kind are not capable of establishing a derogation from the system of mandatory time-limits established by Articles 90 and 91 of the Staff Regulations, still less of exempting the Tribunal from its obligation to verify that the time-limits laid down in those regulations have been complied with.

In order for a person to whom the Staff Regulations apply to be permitted, in an action pursuant to Articles 90 and 91 of the Staff Regulations, to request annulment of an act adversely affecting him, within the meaning of Article 90(2), he must at the time of bringing the action have a vested and present and sufficiently clear interest in obtaining the annulment of that act and such an interest presumes that the claim should be capable, by its result, of securing an advantage for him. As a condition of admissibility, the applicant’s interest in bringing proceedings must be evaluated at the time when the action is brought.

Both the prior administrative complaint and the action before the Tribunal must, under Article 90(2) of the Staff Regulations, be directed against an act adversely affecting the applicant which produces legal effects which are binding on, and capable of affecting, directly and immediately, the interests of the applicant by bringing about a distinct change in his legal position.

Stresses the need for the participating institutions and bodies to devote the necessary staff and financial resources to the ESPAS system through each of their respective budgets, in full compliance with the Financial Regulation, and in particular Article 54(e) thereof, and in the context of the annual budgetary procedure, so as to ensure that this capability can be developed in a budgetarily neutral way in future years, underlines the need for the EU institutions to invest in staff with specific expertise to contribute fully to analysing and monitoring global trends as well as the expertise to identify options and make policy recommendations for the specific needs of each EU institution;

Means of detecting and following up allegations relating to fraud and irregularity have been reinforced considerably over the past five years with the establishment of OLAF, the creation of the Internal Audit Service and of internal capabilities (IACs) in all DGs, the introduction of a specialist Disciplinary and Investigative Office (IDOC) as a Directorate in DG ADMIN, and additional provisions in the new Staff Regulations which come into force in May.

Asks the secretaries-general of the institutions to consider the administrative, budgetary and financial implications of the forthcoming enlargement, with particular reference to staffing requirements, office space and the need to refurbish buildings currently in use; asks in particular that a report be provided by 31 May 2000 showing what steps could be taken in this context to ensure cost-effective translations of a good standard, e.g. by freelance and other outside sources; takes the view that current recruitment methods are not an appropriate and efficient means of recruiting capable staff from the applicant countries; asks the secretaries-general therefore to explore other recruitment policies, such as the setting-up of an interinstitutional agency for the recruitment of staff, on the assumption that the Staff Regulations will be revised in time to allow for this new form of recruitment; requests that such an agency be integrated with other inter-institutional efforts for rationalising staff recruitment;
