By e-mail of 5 May 2011, the applicant submitted a complaint under Article 90(2) of the Staff Regulations of Officials of the European Union (‘the Staff Regulations’) against the selection board’s decision not to include his name on the reserve list.
Par courrier électronique du 5 mai 2011, le requérant a introduit une réclamation sur la base de l’article 90, paragraphe 2, du statut des fonctionnaires de l’Union européenne (ci-après le « statut ») contre la décision du jury de ne pas inscrire son nom sur la liste de réserve.

Since EPSO did not respond to the requests for the production of documents within the time-limits referred to in paragraph 50 above, the time-limits available to the applicant for lodging a complaint within the meaning of Article 90(2) of the Staff Regulations against the decision not to send her written test (b) and against the decision not to send written test (c) expired on 14 September 2009 and 28 October 2009 respectively.
Dans la mesure où l’EPSO n’a pas donné suite aux demandes de production de documents dans les délais rappelés au point 50 du présent arrêt, afin d’introduire une réclamation au sens de l’article 90, paragraphe 2, du statut contre la décision refusant la communication de l’épreuve écrite b) et contre la décision refusant la communication de l’épreuve écrite c), la requérante a disposé d’un délai de trois mois expirant, respectivement, le 14 septembre 2009 et le 28 octobre 2009.

Since, under the system laid down in the Staff Regulations, the person concerned must submit a complaint against the decision which he is contesting and then appeal against the decision rejecting his complaint, the EU judicature has held that the action is admissible whether it is directed against the initial decision alone, the decision rejecting the complaint or both, provided that the complaint and the appeal were lodged within the periods prescribed by Articles 90 and 91 of the Staff Regulations.
Étant donné que, dans le système du statut, l’intéressé doit présenter une réclamation contre la décision qu’il conteste et introduire un recours contre la décision portant rejet de cette réclamation, le juge de l’Union a jugé le recours recevable qu’il soit dirigé contre la seule décision objet de la réclamation, contre la décision portant rejet de la réclamation ou contre ces deux décisions conjointement, dans la mesure où la réclamation et le recours ont été formés dans les délais prévus par les articles 90 et 91 du statut.

Deplores the European Civil Service Tribunal judgment published on 22 May 2014 condemning the EESC for breaching the Charter of Fundamental Rights of the European Union when dismissing one of its staff members in 2013; also deplores the ruling handed down on 8 October 2014 in Case T-530/12 P, M. B. G. v EESC, in which the General Court found against the EESC in connection with the reporting of irregularities concerning the former Secretary-General by the head of the EESC Legal Service; calls on the EESC and its new Secretary-General to take the steps required to prevent further serious breaches of the Charter of Fundamental Rights of the European Union, to inform the EESC Bureau, the members, and the entire staff about the content of the two judgments, and to draw their attention to the fact that officials and other staff covered by the Staff Regulations have an obligation to report irregularities and that the EESC Bureau is an appropriate body to receive such reports; also asks to be informed about the total legal expenses incurred in the last five years in staff cases ultimately dealt with in the courts or by the Ombudsman;

Regrets that the previous Eurostat Internal Audit Service recommendations regarding future contracts with Eurogramme, as well as regarding application of Article 24 of the Staff Regulations in the case of the accusations by Eurogramme against the project officer were not completely followed; calls on the Commission to take due consideration of recommendations from its Internal Audit Service as well as from the internal audit services of its various departments; calls on the Commission to fully apply Article 24 of the Staff Regulations in the above-mentioned case;
