'contribution from members' means any payment in cash, including membership fees, or any contribution in kind, or the provision below market value of any goods, services (including loans) or works, and/or any other transaction which constitutes an economic advantage for the European political party or the European political foundation concerned, when provided to that European political party or to that European political foundation by one of its members, with the exception of usual political activities carried out on a voluntary basis by individual members;

whereas the OSCE expressed serious reservations regarding the scope of the Hungarian laws (material and territorial scope), freedom of expression and the regulation of content, the appointment of one person to act as the national media and telecommunications authority, and compliance with the principles governing public-service broadcasting (4), indicating that the new legislation undermined media pluralism, abolished the political and financial independence of the public-service media and cemented the negative features for the free media in the long term, and that the Media Authority and Media Council were politically homogeneous (5) and exerted pervasive and centralised governmental and political control over all media; whereas further concerns included the disproportionate and extreme penalties imposed for debatable and undefined reasons, the lack of an automatic procedure for suspending penalties in the event of an appeal to the courts against a Media Authority ruling, the violation of the principle of the confidentiality of journalistic sources and the protection of family values,
considérant que l'OSCE a émis de sérieux doutes quant au champ d'application matériel et territorial des dispositions législatives hongroises, à la liberté d'expression et à la teneur de la législation, à la nomination d'une seule et même personne incarnant l'autorité nationale des médias et des télécommunications (4), à la diffusion des médias de service public, indiquant que la nouvelle législation compromet le pluralisme des médias, supprime l'indépendance politique et financière des médias de service public et grave dans le marbre des éléments négatifs pour la liberté des médias sur le long terme, et que l'Autorité des médias et le Conseil sont politiquement homogènes (5) et exercent un contrôle gouvernemental et politique centralisé et envahissant sur tous les médias; que d'autres inquiétudes sont soulevées, entre autres, par les sanctions disproportionnées et extrêmes infligées pour des raisons discutables et floues, l'absence d'une suspension automatique des sanctions en cas de recours en justice introduit contre une sanction prononcée par l'Autorité des médias, la violation du principe de confidentialité des sources journalistiques et la protection des valeurs de la famille,
