Recalls that the international community has committed itself to the adoption of measures that ensure respect for human rights for all and the rule of law as the fundamental basis of the fight against terrorism, through the adoption of the United Nations Global Counter-Terrorism Strategy by the General Assembly in its resolution 60/288, in which member states resolved to take measures aimed at addressing the conditions conducive to the spread of terrorism, including lack of rule of law and violations of human rights, and to ensure that any measures taken to counter terrorism comply with their obligations under international law, in particular human rights law, refugee law and international humanitarian law;

Reiterates its attachment to universal human rights and recalls the fact that sexual orientation is a matter falling within the sphere of the individual right to privacy as guaranteed by international human rights law, according to which equality and non-discrimination should be protected, while freedom of expression should be guaranteed, and reminds the Ugandan authorities of their obligations under international law and under the Cotonou Agreement, which calls for universal human rights to be respected;

This is why we need to reiterate once again the fact that sexual orientation is a matter falling within the remit of the individual’s rights of privacy. It is guaranteed by international human rights law, according to which equality and non-discrimination should be promoted, while freedom of expression should be guaranteed.

Where a person invokes a right in rem to which he is entitled under the law applicable to the succession and the law of the Member State in which the right is invoked does not know the right in rem in question, that right shall, if necessary and to the extent possible, be adapted to the closest equivalent right in rem under the law of that State, taking into account the aims and the interests pursued by the specific right in rem and the effects attached to it.

The EU and the United States are engaged in in-depth dialogue on international law and the combating of terrorism, the significance of which dialogue was highlighted in the statement arising out of the 2006 summit meeting between the EU and the USA: “Consistent with our common values, we will ensure that measures taken to combat terrorism comply fully with our international obligations, including human rights law, refugee law and international humanitarian law. We attach great importance to our ongoing in-depth dialogue on our common fight against terrorism and our respective domestic and international legal obligations”.

The legislation of the Member States should be approximated in such a way as not to conflict with the international conventions on which the copyright and related rights laws of many Member States are based.
