2. In this Act, “Minister” , in relation to any class of matters to which this Act extends in any province or region of a province, means such member of the Queen’s Privy Council for Canada as is designated by the Governor in Council as the Minister for the purposes of this Act in relation to that class of matters in that province or region of a province.

In other words, such aid may not under any circumstances constitute aid for exports; - the aid will have to be objectively quantifiable beforehand on the basis of a ratio "aid per kilometre travelled" or on the basis of a ratio "aid per kilometre travelled" and "aid per unit of weight", and will have to form the subject-matter of an annual report drawn up on the basis of such ratio(s); - estimates of the extra cost will have to be based on the cheapest means of transport and the most direct route between the place of production/processing and the commercial outlets; - aid may be granted only to businesses located in an area eligible for regional aid on the strength of the new criterion of low population density; - the products of firms for which there is no possible alternative location (products of the extractive industries, hydroelectric power stations, etc.) will not be eligible for transport aid. - any transport aid granted to firms in sectors considered sensitive by the Commission (motor vehicles, textiles, synthetic fibres, shipbuilding, ECSC sectors and steel falling outside the scope of the ECSC Treaty) will be subject to the requirement of prior notification and to the sectoral guidelines applicable; - agricultural products falling within Annex II of the EC Treaty are not covered by the present provisions and will form the subject-matter of an appropriate proposal in due course.
En d'autres termes, ces aides ne pourront en aucun cas constituer des aides à l'exportation, - les aides devront être objectivement quantifiables ex ante sur la base d'un ration "aide par kilomètre parcouru" ou sur la base d'un ratio "aide par kilomètre parcouru" et "aide par unité de poids" et devront faire l'objet d'un rapport annuel établi sur la base notamment du (des) dit(s) ratio(s), - l'estimation du surcoût devra prendre pour base le moyen de transport le plus économique et la voie la plus directe entre le lieu de production/transformation et les débouchés commerciaux, - les aides ne pourront être octroyées qu'aux entreprises situées en zone éligible aux aides d'Etat à finalité régionale sur la base du nouveau critère de la faible densité de population, - seront exclus du bénéfice des aides au transport, les produits des entreprises dont la location ne peut pas faire l'objet d'une alternative (produits d'extraction, centrales énergétiques hydrauliques, ...), - les aides au transport octroyées en faveur des entreprises appartenant aux secteurs considérés comme sensibles par la Commission (automobile, textile, fibres synthétiques, construction navale, secteurs CECA et acier tombant hors du champ d'application du traité CECA) seront soumises à l'obligation de notification préalable et aux orientations sectorielles en vigueur, - les produits agricoles relevant de l'Annexe II du Traité CE ne sont pas couverts par les présentes dispositions et feront l'objet d'une proposition appropriée en temps utile.
