(13) In order to accommodate developments in the misuse of chemical substances as precursors to explosives and provided that proper consultation with relevant stakeholders is carried out in order to take into account the potentially significant impact on economic operators, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission in respect of amendments to Annex I to this Regulation as regards concentration limits for substances and to Annex II to this Regulation as regards addition of substances.

Believes that some flexibility needs to be shown for the ORs as regards concentration on the three main thematic objectives laid down in the new proposals for regulations from 2014, so as to avoid excessively restricting the possibility of diversifying and developing existing potential and of exploiting their comparative and competitive advantages;

As regards Directive 94/62/EC, the Commission should be empowered to examine and, where necessary, review the illustrative examples for the definition of packaging and to determine the conditions under which concentration levels of heavy metals present in packaging or packaging components will not apply to some materials and product loops, the types of packaging exempted from the requirement regarding concentration levels and the technical measures necessary to deal with any difficulties encountered in applying the provisions of this Directive.

The chief handicaps include: rising costs, particularly those resulting from expanding requirements as regards traceability, marketing and labour; in addition, the high degree of dependence on paid labour, particularly for harvesting and post-harvest handling, which, in the absence of social and fiscal harmonisation at Community level, leads to distortions of competition within the single market; the excessive orientation towards internal markets which are facing growing competition from outside; the predominance of small farms, particularly in the south and in the fruit sector: and finally, despite the progress achieved as regards concentrating supply, a still high degree of commercial fragmentation in the productive sector, which is unable to negotiate on equal terms with a highly concentrated distribution that, thanks to superstores and their purchasing centres, has ceased to be simply a link between the producer and the end consumer and has become the main price-setter all along the chain.

3. As regards concentrations to which this Regulation applies by virtue of accession, the date of accession shall be substituted for the date of application of this Regulation.

2. Initially not more than one year after the entry into force of this Regulation and, thereafter periodically, the Commission shall draw up a report examining the treatment accorded to undertakings having their seat or their principal fields of activity in the Community, in the terms referred to in paragraphs 3 and 4, as regards concentrations in third countries.

Considers that competition policy should play a major role in ensuring an open and competitive media sector; welcomes therefore the Commission's investigations launched in relation to several public broadcasters to verify the existence of overcompensations and cross-subsidies; invites the Commission and the Member States, at the same time, to be very vigilant regarding concentration processes and existing dominant positions held by both private and public operators in this sector;

With regard to a concentration as defined in Article 3 which does not have a Community dimension within the meaning of Article 1 and which is capable of being reviewed under the national competition laws of at least three Member States, the persons or undertakings referred to in paragraph 2 may, before any notification to the competent authorities, inform the Commission by means of a reasoned submission that the concentration should be examined by the Commission.
5. With a view to preserving the guidance that may be drawn from past judgments of the European courts and Commission decisions pursuant to Regulation (EEC) No 4064/89, while at the same time maintaining consistency with the standards of competitive harm which have been applied by the Commission and the Community courts regarding the compatibility of a concentration with the common market, this Regulation should accordingly establish the principle that a concentration with a Community dimension which would significantly impede effective competition, in the common market or in a substantial part thereof, in particular as a result of the creation or strengthening of a dominant position, is to be declared incompatible with the common market.
Afin de préserver les enseignements pouvant être tirés des précédents arrêts prononcés par les juridictions européennes et des décisions prises par la Commission en vertu du règlement (CE) n° 4064/89, tout en sauvegardant en même temps la cohérence avec les critères de détermination du préjudice concurrentiel appliqués par la Commission et les juridictions communautaires pour statuer sur la compatibilité d'une concentration avec le marché commun, le présent règlement devrait en conséquence établir le principe selon lequel les concentrations de dimension communautaire qui entraveraient de manière significative une concurrence effective, notamment du fait de la création ou du renforcement d'une position dominante, dans le marché commun ou une partie substantielle de celui-ci doivent être déclarées incompatibles avec le marché commun.
