To address the problems faced by EU citizens related to cross-border car taxation, the Commission presented on 14 December 2012 a Communication "Strengthening the Single Market by removing cross-border tax obstacles for passenger cars"[89], clarifying EU rules on car taxation and identifying best practices that Member States should implement, such as informing citizens of their rights and obligations in relation to the application of car taxes in cross-border situations and refunding part of the registration tax for cars which are permanently transferred to another Member State, so as to avoid double taxation.
Pour s’employer à résoudre les problèmes rencontrés par les citoyens de l’Union dans le domaine de la fiscalité automobile transfrontière, la Commission a présenté, le 14 décembre 2012, une communication intitulée «Renforcer le marché unique en supprimant les obstacles fiscaux transfrontières pour les voitures particulières»[89], clarifiant ainsi les règles de l’UE sur la fiscalité automobile et recensant les meilleures pratiques que les États membres devraient mettre en œuvre, tels l’information des citoyens sur leurs droits et obligations par rapport à l’application de taxes automobiles dans les situations transfrontières et le remboursement d’une partie de la taxe d’immatriculation pour les automobiles qui sont transférées à titre permanent dans un autre État membre, afin d’éviter la double imposition.

With respect to the refund referred to in the first indent of recital 16, the Commission, on the basis of information in its possession, considered in connection with the decision initiating the formal investigation procedure that the refund (which was part of the rebates referred to in that decision) contained an aid element, because it was financed by the State, which, by granting the refund, deprived itself of resources.

Where the Member State of refund requests further additional information, it shall notify the applicant of its decision in respect of the whole or part of the refund application within eight months of receipt of the application by that Member State.

However, the period available for the decision in respect of the whole or part of the refund application shall always be at least six months from the date of receipt of the application by the Member State of refund.
