As for determining the quantities entitling to a refund , the French authorities explain that the mechanism was designed to adapt the sector in France to the abolition of quotas, the aim being to maintain at an even level the tax on surpluses by granting a refund to small producers in a fragile situation (15 % of producers, or 10 % of the national quota).
En ce qui concerne la détermination des quantités donnant droit à remboursement , les autorités françaises expliquent que le mécanisme a été conçu pour adapter la filière française à la sortie des quotas, l'objectif étant de garder à un niveau régulier l'enveloppe de taxe sur les excédents en accordant un remboursement aux petits producteurs fragilisés (15 % des producteurs représentant 10 % du quota national).

According to the French authorities, the mechanism complies with the progressivity principles applied to tax brackets referred to in point 24 of the Commission notice on the application of the State aid rules to measures relating to direct business taxation , and a supplementary refund mechanism has been introduced for producers who are not eligible for the refund for ‘small producers’ but are nonetheless in a fragile situation in terms of the reference quantity held, the aim being to avoid threshold effects.

(31) In order to monitor the expenditure on export refunds and the implementation of the refund certificate system, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of rules on the rights and obligations deriving from the refund certificates, rules on their transfer or restrictions on that transfer , the cases and situations where the presentation of a refund certificate or the lodging of a security is not required and the tolerance within which the obligation to apply for refunds does not apply.
(31) Afin de surveiller les dépenses pour les restitutions à l'exportation et la mise en œuvre du système de certificats de restitution, il convient de déléguer à la Commission le pouvoir d'adopter des actes conformément à l'article 290 du traité sur le fonctionnement de l'Union européenne concernant les règles sur les droits et obligations découlant des certificats de restitution, les règles relatives à leur transfert ou les restrictions à leur transfert , les cas et situations dans lesquels la présentation d'un certificat de restitution ou la constitution d'une garantie n'est pas requise, et la tolérance dans les limites de laquelle l'obligation de demander les restitutions ne s'applique pas.

If, under the law of the Member State of refund, failure to take a decision on a refund application within the time limits specified in this Directive is not regarded either as approval or as refusal, any administrative or judicial procedures which are available in that situation to taxable persons established in that Member State shall be equally available to the applicant.
Si l’absence de décision concernant la demande de remboursement dans les délais prévus par la présente directive ne vaut ni acceptation ni rejet dans la législation de l’État du remboursement, le requérant doit avoir accès à toute procédure administrative ou judiciaire à laquelle ont accès les assujettis établis dans cet État membre lorsqu’ils se trouvent dans la même situation.
