Dans l’affirmative, le mémorandum du 23 juin 2009 d’entente entre la Communauté européenne et la Roumanie, publié au Monitorul Oficial no 455 du 1er juillet 2009, doit-il être interprété en ce sens que, en vue de la réduction des effets de la crise économique par la réduction des frais de personnel, la Commission européenne peut valablement imposer l’adoption d’une loi nationale privant une personne de son droit de percevoir la pension contributive pour plus de 30 ans de cotisations, fixée conformément à la loi et perçue antérieurement à ladite loi, au motif que cette personne perçoit un salaire pour une activité exercée au titre d’un contrat de travail, différente de celle pour laquelle elle a été mise à la retraite?

Before the institution starts to operate a pension scheme for a sponsoring undertaking in another Member State, the competent authorities of the host Member State shall, within two months of receiving the information referred to in paragraph 3, inform the competent authorities of the home Member State, if appropriate, of the requirements of social and labour law relevant to the field of occupational pensions under which the pension scheme sponsored by an undertaking in the host Member State must be operated and any rules that are to be applied in accordance with Article 18(7) and with paragraph 7 of this Article.
5. Avant qu'une institution ne commence à gérer un régime de retraite pour une entreprise d'affiliation dans un autre État membre, les autorités compétentes de l'État membre d'accueil disposent de deux mois, à compter de la réception des informations visées au paragraphe 3, pour indiquer, le cas échéant, aux autorités compétentes de l'État membre d'origine les dispositions de son droit social et de son droit du travail relatives aux retraites professionnelles qui régiront la gestion du régime de retraite pour le compte d'une entreprise de l'État membre d'accueil ainsi que toute disposition qu'il y a lieu d'appliquer conformément à l'article 18, paragraphe 7, et au paragraphe 7 du présent article.
