For the purposes of the present appeal, it must first be stated that the Civil Service Tribunal recalled that any decision relating to a specific individual which is taken under the Staff Regulations and adversely affects that person must state the reasons on which it is based, on the one hand, to enable the competent court to review the legality of the decision and, on the other, to provide the person concerned with the information necessary to allow him to ascertain whether or not the decision is well founded and to enable him to decide whether to bring an action. It added, however, referring to Case C‑254/95 P Parliament v Innamorati [1996] ECR I‑3423, paragraphs 24 to 28, that, as far as concerns decisions taken by a selection board in a competition, the obligation to state reasons must be reconciled with observance of the secrecy surrounding the proceedings of selection boards by virtue of Article 6 of Annex III to the Staff Regulations, secrecy which was instituted with a view to guaranteeing the independence of selection boards and the objectivity of their proceedings. Thus, observance of this secrecy precludes both disclosure of the attitudes adopted by individual members of selection boards and disclosure of any factors relating to individual or comparative assessments of candidates and that the obligation to state the reasons on which decisions of a selection board in a competition are based must take account of the nature of the proceedings concerned, which, at the stage of examination of the abilities of the candidates, are primarily comparative in character and accordingly covered by the secrecy inherent in those proceedings (paragraphs 30 and 31 of the judgment under appeal).
Aux fins du présent pourvoi, en premier lieu, il convient de relever que le Tribunal de la fonction publique a rappelé que toute décision individuelle prise en application du statut et faisant grief doit être motivée, et que l’obligation de motivation a pour objet, d’une part, de permettre au juge d’exercer son contrôle sur la légalité de la décision et, d’autre part, de fournir à l’intéressé les indications nécessaires pour savoir si la décision est ou non fondée et lui permettre d’apprécier l’opportunité de l’introduction d’un recours. Il a néanmoins ajouté, en faisant référence à l’arrêt de la Cour du 4 juillet 1996, Parlement/Innamorati (C‑254/95 P, Rec. p. I‑3423, points 24 à 28), que, en ce qui concerne les décisions prises par un jury de concours, l’obligation de motivation doit être conciliée avec le respect du secret qui entoure les travaux du jury en vertu de l’article 6 de l’annexe III du statut, secret institué en vue de garantir l’indépendance des jurys de concours et l’objectivité de leurs travaux. With regard, in particular, to three-dimensional trade marks consisting of the packaging of goods, such as liquids, which are packaged in trade for reasons linked to the very nature of the product, the Court has held that they must enable average consumers of the goods in question, who are reasonably well informed and reasonably observant and circumspect, to distinguish the product concerned from those of other undertakings without conducting an analytical or comparative examination and without paying particular attention (see, to that effect, with regard to Article 3(1)(b) of First Council Directive 89/104/EEC of 21 December 1988 to approximate the laws of the Member States relating to trade marks (OJ 1989 L 40, p. 1), which provision is identical to Article 7(1)(b) of Regulation No 40/94, Case C‑218/01 Henkel [2004] ECR I‑1725, paragraph 53).

I, today, have just found out about two new reasons to re-examine this report and it surprises me, because in fact it deals with something else, of another political approach, and I would welcome its being done clearly. From the point of view, not of my political group, but of the previous Parliament, of the Committee on Constitutional Affairs, which unanimously approved this report, there is really no lack of clarity.
Aujourd'hui, j'ai appris que deux nouveaux arguments étaient avancés pour que l'on réexamine ce rapport et cela me semble surprenant car il s'agit en réalité d'autre chose, d'un autre point de vue politique et ce serait bien que cela soit dit clairement. Du point de vue, non pas de mon groupe politique, mais du Parlement précédent, de la commission des affaires constitutionnelles, qui a approuvé ce rapport à l'unanimité, il n'y a vraiment aucun problème de clarté.
