(2) If the Committee finds that, at the date of the commencement of a hearing of an application for the amendment of a unitization order, one or more working interest owners who own in the aggregate sixty-five per cent or more of the total working interests and one or more royalty interest owners who own in the aggregate sixty-five per cent or more of the total royalty interests in the unit area have consented to the proposed amendment, the Committee may amend the unitization order in accordance with the amendment proposed.

However, if the expert finds that, on the day on which the hearing begins, one or more working interest owners who own in total 65% or more of the total working interests and one or more royalty interest owners who own in total 65% or more of the total royalty interests in the unit area have consented to the proposed amendment, the expert may end the hearing and request that the minister and appropriate regulator each amend their unitization orders in accordance with the amendment proposed.
Toutefois, s’il constate, au début de l’audience, qu’un ou plusieurs détenteurs qui possèdent en tout au moins 65 % de l’ensemble des intérêts économiques directs et un ou plusieurs titulaires de redevance qui possèdent en tout au moins 65 % de l’ensemble des droits à redevance sur le secteur unitaire ont consenti à la modification, l’expert peut mettre fin à l’audience et demander au Ministre et à l’organisme de réglementation concerné de modifier l’arrêté en conséquence.

It is therefore a balanced and mutually advantageous agreement, which is why I recommend that Parliament approve my report, with the amendment introduced by the Development Committee and with my own proposed amendments, which merely seek to reinforce Parliament’s position in monitoring these areas.
