(14) In order to make the entire market surveillance process transparent and easy to follow for both market surveillance authorities and economic operators, the Regulation should clearly set out the chronological steps of that process, from the moment when market surveillance authorities identify a product which they believe may present a risk, to the assessment of the risk presented, the corrective action to be taken by the relevant economic operator within a specified period and the measures to be taken by market surveillance authorities themselves if economic operators do not comply or in cases of urgency.

The competent authority shall ensure that the provisions of this Regulation are applied on its territory, regarding all actions carried out on its territory, and actions carried out abroad relating to instruments admitted to trading on a regulated market, for which a request for admission to trading on such market has been made, auctioned on an auction platform or which are traded on an MTF or an OTF or for which a request for admission to trading has been made on an MTF operating within its territory.

3. In order to achieve the objectives set out in paragraph 2, Member States shall require the regulatory functions of the competent authority to be carried out within an authority that is independent of any of the functions of the Member State relating to the economic development of the offshore natural resources and licensing of offshore oil and gas operations within the Member State and the collection and management of revenues from those operations.

Member States shall ensure that decisions on granting or transferring licences to carry out offshore oil and gas operations take into account the capability of an applicant for such a licence to meet the requirements for operations within the framework of the licence as required by the relevant provisions of Union law, in particular this Directive.

However, they may also, exceptionally, be approved where they apply to the entire fleet operated by a shipowner established within a Member State's territory liable to corporate tax, provided that it is demonstrated that the strategic and commercial management of all ships concerned is actually carried out from within the territory and that this activity contributes substantially to economic activity and employment within the Community.
À titre exceptionnel, ces régimes peuvent cependant être autorisés lorsqu'ils s'appliquent à la totalité de la flotte exploitée par un armateur établi sur le territoire d'un État membre où s'applique la taxe sur le chiffre d'affaires, à condition qu'il soit démontré que la gestion stratégique et commerciale de tous les navires en cause a effectivement lieu à partir de ce territoire, et que cette activité contribue sensiblement à l'activité économique et à l'emploi dans la Communauté.

As regards derivative instruments not admitted to trading but falling within the scope of this Directive, each Member State should be competent to sanction actions carried out on its territory or abroad which concern underlying financial instruments admitted to trading on a regulated market situated or operating within its territory or for which a request for admission to trading on such a regulated market has been made.
Pour ce qui est des instruments dérivés qui ne sont pas admis à la négociation mais qui relèvent du champ d'application de la présente directive, chaque État membre devrait être compétent pour sanctionner les actes accomplis sur son territoire ou à l'étranger et qui concernent des instruments financiers sous-jacents admis à la négociation sur un marché réglementé situé ou opérant sur son territoire ou pour lesquels a été présentée une demande d'admission à la négociation sur ce marché réglementé.
