However, where a Commission proposal amends an existing act and the United Kingdom or Ireland do not exercise their right to opt into the amending measure, the Council, acting on a proposal from the Commission, can determine that the non-participation of the respective country in the amended version of the existing measure makes the application of that measure inoperable for other Member States or the Union, in which case the period for making the notification is extended.
