It is estimated that this directive could mean the banning of 15% of pesticides. It is estimated that such a ban would cut wheat yield by 26% to 62%, potato yield by 22% to 53% and some other vegetable yields by 25% to 77%.

The Commission regards this ban as disproportionate to the objective of general interest, which is to protect European cultural diversity; moreover, the available data indicate that by restricting the possibilities for operators from other Member States to advertise with a view to gaining access to the French market, this ban is depriving French consumers of a wider range of European cultural goods and could therefore even have discriminatory effects on cultural products from other Member States.
La Commission estime en effet que cette interdiction est disproportionnée par rapport à l'objectif d'intérêt général recherché, qui est la protection de la diversité culturelle européenne; d’ailleurs, sur base des indications dont elle dispose, la Commission estime qu’en restreignant la possibilité pour des opérateurs d’autres Etats membres de faire de la publicité et d’utiliser un moyen de promotion très efficace pour pénétrer le marché français, cette mesure est de nature à priver les consommateurs français d’une offre plus diversifiée de biens culturels européens. It proposes to apply the marketing ban to cases in which full replacement alternatives are not available but where third country producers could have used other ‘alternative tests’. This is to be welcomed in that it demonstrates an apparent willingness not only to maintain, but also to extend the existing marketing ban.

In the FEDERAL REPUBLIC OF GERMANY, where public health questions are also within the field of competence of the Länder, provisions on banning smoking in public places are not uniform. However, smoking is generally banned in schools and other educational establishments and non-smoking areas are provided in certain forms of transport. In BELGIUM, FRANCE and SPAIN, the law sets out in detailed form the places where smoking is banned. This ban covers most premises accessible to the public, with particular stress on establishments for young people or where health care is given. However, Belgian and Spanish legislation provides that in some areas where the ban applies an area may be set aside for smokers. Smoking areas are also authorized on certain forms of transport. It shoule be noted that in the event of a dispute, Spanish legislation provides that the right to health of non-smokers prevails over the rights of smokers in all places where the right to health of non-smokeres might be affected. In DENMARK a Government decision establishes that, within its area of competence, the Government should measures to ban or restrict smoking in some public places and some public transport before 1 July 1988. In IRELAND an Order of July 1988 allows the adoption of legislative measures to ban or restrict smoking in some public places. In GREECE, ITALY and PORTUGAL there are restrictions on the use of tobacco in some public places and forms of transport. In the NETHERLANDS restrictions are generally confined to hospitals and places of entertainment. In LUXEMBOURG restrictions are limited to public transport and places of entertainment.
