Any official or servant of the European Parliament who becomes aware of evidence which gives rise to a presumption of the existence of possible cases of fraud, corruption or any other illegal activity detrimental to the interests of the Communities, or of serious situations relating to the discharge of professional duties which may constitute a failure to comply with the obligations of officials or servants of the Communities or staff not subject to the Staff Regulations liable to result in disciplinary or, in appropriate cases, criminal proceedings, shall inform without delay his Head of Service or Director-General or, if he considers it useful, his Secretary-General or the Office direct, in the case of an official, servant or staff member not subject to the Staff Regulations, or, in the case of failure to comply with the analogous obligations of Members, the President of the European Parliament.

3. As soon as an investigation reveals that an official, other servant, member of an institution or body, head of office or agency, or staff member may be a person concerned, that official, other servant, member of an institution or body, head of office or agency, or staff member shall be informed to that effect, provided that this does not prejudice the conduct of the investigation or of any investigative proceedings falling within the remit of a national judicial authority.
3. To that end, it shall investigate serious matters relating to the discharge of professional duties constituting a dereliction of the obligations of officials and other servants of the Union liable to result in disciplinary or, as the case may be, criminal proceedings, or an equivalent failure to discharge obligations on the part of members of institutions and bodies, heads of offices and agencies or staff members of institutions, bodies, offices or agencies not subject to the Staff Regulations (hereinafter collectively referred to as ‘officials, other servants, members of institutions or bodies, heads of offices or agencies, or staff members’).

The Office should be placed under precise obligations to inform the institutions, bodies, offices and agencies of investigations in progress where an official, other servant, member of an institution or body, head of office or agency, or staff member is concerned by the matter under investigation or where precautionary measures may be required in order to protect the financial interests of the Union.
L’Office devrait être soumis à l’obligation précise d’informer les institutions, organes et organismes des enquêtes en cours lorsqu’un fonctionnaire, un autre agent, un membre d’une institution ou d’un organe, un dirigeant d’un organisme ou un membre du personnel est concerné par les faits faisant l’objet d’une enquête ou lorsque des mesures conservatoires pourraient être requises afin de protéger les intérêts financiers de l’Union.

In that regard, the special regime of strict liability introduced by that provision is based on the administration’s duty to protect the health and safety of its officials and servants against attacks or ill-treatment emanating from third parties or other officials of which they may be victims in the performance of their duties, particularly in the form of psychological harassment, within the meaning of Article 12a(3) of the Staff Regulations.

Given the intrinsically legal nature of a plea alleging illegality of a legislative or regulatory text, and also of the reasoning which underlies contemplating and then pleading illegality of this nature, the official or servant who lodges the complaint, and who does not necessarily have the appropriate legal expertise, cannot be required to formulate such a plea at the pre-contentious stage, failing which it will be declared inadmissible in the legal proceedings.

"1a. By way of derogation from paragraph 1(a)(i) the Appointing Authority shall, and by way of derogation from paragraph 1(b) the Appointing Authority may, consider the possibility of filling a vacant post by appointing as officials temporary servants engaged in accordance with Article 2(c) of the Conditions of Employment of other servants of the European Communities to assist a political group in the European Parliament, the European Economic and Social Committee or the Committee of the Regions, provided that they have passed a selection procedure in accordance with Article 1b(2b), of the Staff Regulations of officials of the European Communities and have been in service as such temporary servants for more than seven years".
