The reason for using Article 308 and not Article 181a is not in the Treaty, but in Declaration No. 10 attached to the Treaty of Nice, setting out that "balance-of-payments aid to third countries falls outside the scope of Article 181a".
La raison de recourir à l’article 308 et non à l’article 181 A ne réside pas dans le traité, mais dans la déclaration n°10 annexée au traité de Nice, qui prévoit que "les aides à la balance des paiements des pays tiers ne relèvent pas du champ d'application de l'article 181 A".

The European Parliament questioned the relevance of Article 181a of the Treaty as a legal basis and proposed a dual legal basis, Article 181a together with Article 179 (development cooperation, under the codecision procedure), since many countries eligible according to Annex 1 are developing countries under the OECD list.

Respect for these principles is required of countries which apply for EU membership (Article 49 of the EU Treaty) and promoting them is included in all forms of cooperation with third countries, including development cooperation (Article 181a of the Treaty establishing the European Community (EC)).

Whereas the Council's Legal Service maintains that “Article 181a empowers the Community, within its sphere of competence, to adopt 'economic, financial and technical cooperation measures' with third (non-developing) countries” and “Article 181a was introduced in the TEC by the Treaty of Nice in order to provide a specific legal basis for technical and financial assistance measures outside the Community's development cooperation policy”, the Commission argues that Article 181a is needed in order to allow it to "carry out certain - unspecified - economic cooperation activities with developing countries".

Given the wording of Article 181a (which opens with the words "Without prejudice to the other provisions of this Treaty, and in particular those of Title XX") and the fact that it refers simply to third countries and not to developing countries, the view taken by Parliament's Legal Service commends itself – that is to say, that economic cooperation with developing countries falls outside the scope of Article 181a.

Your rapporteur, Mr Seppänen, is of the opinion that the correct legal basis for the EC part of the proposal would be Article 181a EC (Economic, financial and technical cooperation with third countries) and has therefore presented an amendment changing the legal base from Article 308 EC to Article 181a EC.
