(9) Where a tariff of an air carrier or agent not subject to the jurisdiction of the Agency is filed with the Agency and a non-concurring air carrier participates therein, the said tariff shall be effective and the tolls, the terms and conditions therein applicable unless the non-concurring air carrier has applied for and received an order from the Agency disallowing the tariff.

Where the flight is code-shared between one or more air carriers the obligation to transfer the PNR data of all passengers on the flight shall be on the air carrier and the non-carrier economic operator that operates the flight. Where the flight has one or more stop-overs at the airports of the Member States, air carriers and non-carrier economic operators shall transfer the PNR data to the Passenger Information Units of all the Member States concerned.

The EU Air Safety List is established by the European Commission, pursuant to Regulation (EC) No 2111/2005 of the European Parliament and the Council of 14 December 2005 on the establishment of a Community list of air carriers subject to an operating ban within the Community and on informing air transport passengers of the identity of the operating air carrier and on the basis of the advice of the EU Air Safety Committee.

2. An air carrier and the managing body of an airport may agree that, for the passengers whom that air carrier transports to and from the airport, the managing body shall provide assistance of a higher standard than the standards mentioned in paragraph 1 or provide services additional to those specified in Annex I. For the purpose of funding either of these, the managing body may levy a charge on the air carrier additional to that mentioned in Article 8(3) , which shall be transparent, cost related and established after consultation of the air carrier concerned.

Where the identity of the operating air carrier or carriers is not yet known at the time of reservation, the air carriage contractor shall ensure that the passenger is informed of the name or names of the air carrier or carriers that is or are likely to act as operating air carrier or carriers on the flight or flights concerned.

Moreover, Member States will have to perform regular inspections to verify the compliance with the proposed Regulation of air carriers using airports in their territory, or air carriers and air operators under their control (to which they have delivered an operating licence -air carriers- or an aircraft operator's certificate).
