These were their recommendations: first, that the Native Women's Association of Canada and Assembly of First Nations be consulted in order to draft legislation, or Indian Act amendments; second, provide funds to help first nations draft their own matrimonial property rights codes; third, legislation should not apply to first nations that draft their own codes; fourth, amend the Canadian Human Rights Act to apply on reserves; and fifth, stress that all recommendations be Canada's recognition of first nations' inherent right of self-governance.

That, in the opinion of the House, the Indian Act is the embodiment of failed colonial and paternalistic policies which have denied First Nations their rights, fair share in resources; fostered mistrust and created systemic barriers to the self-determination and success of First Nations, and that elimination of these barriers requires the government to initiate a formal process of direct engagement with First Nations within three months of passage of this motion, on a nation-to-nation basis, which focuses on replacing the Indian Act with new agreements based on: (a) the constitutional, treaty, and inherent rights of all First Nations; (b) the historical and fiduciary responsibilities of the Crown to First Nations; (c) the standards established in the United Nations Declaration on the Rights of Indigenous Peoples, including the principle of free, prior, and informed consent; (d) respect, recognition, reconciliation and support for First Nations; (e) partnership and mutual accountability between the Crown and First Nations; and (f) stability and safety of First Nations; and that this process be completed within two years before reporting with a series of concrete deliverables for the government to act upon.

Interesting questions have been referred to the Court of Justice by national courts, for instance on the impact of the right to an effective remedy and to a fair trial in expulsion proceedings against EU citizens that rely on security sensitive information that the public authorities do not want to reveal in a public hearing.[19] Another question touches on the important issue of the relationship between national fundamental rights and EU fundamental rights in a case concerning the application of the European Arrest Warrant[20].

Calls on the EU Member States to sign up to, and ratify, the core Council of Europe and United Nations human-rights conventions and the additional optional protocols: among others, the European Social Charter (revised), the Convention on Action against Trafficking in Human Beings, the Framework Convention for the Protection of National Minorities, the European Charter for Regional or Minority Languages of the Council of Europe, as well as the UN Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the UN Convention relating to the Status of Refugees, the UN Convention on the Protection of the Rights of All Migrant Workers and Members of their Families, the UN Convention on Organised Crime and its two protocols against human trafficking and smuggling, the UN Convention on the Elimination of All Forms of Discrimination against Women, the UN Convention on the Rights of the Child and the UN Convention on the Rights of Persons with Disabilities; furthermore, suggests that, in the European legislative process, more account be taken of international documents and more reference made to them;

Stresses the need for appropriate attention to the various UN monitoring mechanisms and to the findings of the UN human-rights bodies, and suggests that their recommendations relevant to Member States be followed closely; points out the importance of the Universal Periodic Review (UPR) of the United Nations Human Rights Council; recommends cooperation with the Office of the High Commissioner for Human Rights and the office of the High Commissioner for Refugees of the United Nations; and welcomes the opening, in Brussels, of the first European Regional Office of the UN High Commissioner for Human Rights;

As a follow-up to the last year’s Human Rights Dialogue, the Armenian delegation informed about the human rights situation in Armenia, in particular regarding the national human rights legislation and its enforcement, the functioning of the judicial system, the freedom of association and assembly, the freedom of expression and the media, elections and electoral framework, the freedom of thought and religion, the rights of prisoners, including fight against torture and cruel, inhuman and degrading treatment and the cooperation between Armenia and EU in international fora, particularly within the United Nations, OSCE, and Council of Europe for the promotion of human rights.

As the United Nations human rights committee stated, “The right to life.is the supreme right from which no derogation is permitted” even in time of public emergency which threatens the life of the nation.

In the case of varieties for which a national plant variety right was granted prior to the grant of the Community plant variety right, but to which Article 116 (4) 4th indent of the said Regulation does not apply, the extension referred to in paragraph 1 shall be reduced by the longest period in full years during which any national property right or rights granted have been effective in a Member State in respect of the same variety prior to the grant of the Community plant variety right.
