Is the Commission aware of the comments made by the US Secretary of State, Mrs Albright, ruling out any possibility that the US Congress might amend title IV of the Helms-Burton Act, thereby failing to comply with one of the core aspects of the agreement between the European Commission and the Clinton administration, part of the new arrangements provided for by the Transatlantic Summit between the US and the European Union in May 1998?
La Commission a-t-elle eu connaissance des déclarations faites par la Secrétaire d'État américaine, Mme Albright, sur l'impossibilité pour le Congrès des États-Unis de modifier le titre IV de la loi Helms-Burton, ce qui signifie que l'un des éléments essentiels de l'accord intervenu entre la Commission européenne et l'Administration Clinton dans le nouveau cadre du sommet transatlantique entre les États-Unis et l'Union européenne en mai 1998 ne serait pas respecté?

(3) Whereas missions on BSE-related issues have been carried out in Portugal by the Commission Office for Veterinary and Phytosanitary Inspection and Control from 7 to 12 July 1996 and by the Food and Veterinary Office of the Commission from 15 to 21 June 1997 and from 11 to 15 May 1998; whereas those missions contributed to the assessment of the application and effectiveness of measures to protect against BSE; whereas those missions concluded that, despite important improvements, not all risk factors were adequately managed; whereas a follow-up mission was conducted by the food and Veterinary Office from 28 September to 2 October 1998; whereas that mission confirmed most of the findings of the previous missions and observed, despite an overall improvement, certain continued shortcomings in the enforcement of the measures to control the risk factors; whereas the sharp increase in the incidence of BSE, in particular since June 1998, raises serious concerns with regard to the development of the disease in the near future; whereas on the basis of that mission it is concluded that due to deficiencies existing until very recently in the implementation of Community legislation on identification and registration of animals, and of measures on TSE surveillance and BSE eradication, no adequate guarantees can be provided regarding the BSE history of the herds of origin and herds through which bovine animals pass and regarding the dams of bovine animals;
(3) considérant que plusieurs missions concernant des problèmes liés à l'ESB ont été effectuées au Portugal par l'office d'inspection et de contrôle vétérinaire et phytosanitaire de la Commission entre le 7 et le 12 juillet 1996 et par l'office alimentaire et vétérinaire de la Commission du 15 au 21 juin 1997 et du 11 au 15 mai 1998; que ces missions ont contribué à l'évaluation de l'application et de l'efficacité des mesures de protection contre l'ESB; que ces missions ont conclu qu'en dépit d'importantes améliorations, la gestion de tous les facteurs de risque n'était pas encore adéquate; qu'une mission de suivi a été effectuée par l'office alimentaire et vétérinaire entre le 28 septembre et le 2 octobre 1998; que cette mission a confirmé la plupart des conclusions des missions précédentes et constaté, en dépit d'une amélioration globale de la situation, la persistance de certaines carences dans la mise en oeuvre des mesures de lutte contre les facteurs de risque; que la forte augmentation de l'incidence des cas d'ESB, notamment depuis juin 1998, donne lieu à de sérieuses préoccupations concernant l'évolution à court terme de la maladie; que les résultats de cette mission permettent de conclure qu'en raison d'insuffisances constatées encore très récemment dans la mise en oeuvre de la législation communautaire en matière d'identification et d'enregistrement des animaux, et des mesures de surveillance des EST et d'éradication de l'ESB, des garanties adéquates ne peuvent être fournies concernant les antécédents au regard de l'ESB des troupeaux d'origine et des troupeaux de transit, ainsi que des mères des bovins;

The Partnership and Cooperation Agreement concluded with the Republic of Moldova will enter into force on 1 July 1998, the notifications regarding the completion of the procedures laid down in Article 105, second paragraph, of the Agreement having been completed by the parties on 29 May 1998.
