The International Court of Justice (ICJ). The ICJ was founded by the Charter of the United Nations, signed on 26 June 1945. It is the main judicial body in the United Nations family and has jurisdiction in, among other matters, questions relating to the Charter of the United Nations, the interpretation of international treaties, questions of international law, violations of international law and the nature and extent of compensation in the event of a violation of an obligation under international law.
La Cour internationale de Justice (CIJ) est l'organe judiciaire principal des Nations unies et est, entre autres, compétente pour les questions relatives à la Charte des Nations unies, à l'interprétation des traités internationaux, aux questions de droit international, à la constatation de violation du droit international, ou bien à la nature ou l'extension de la réparation suite à la violation d'une obligation de droit international.

– (FI) Mr President, President-in-Office of the Council, I will take advantage of this opportunity as I have drafted my own question on the same matter, Question No 17, which there may be no time to answer during this Question Time.

Welcomes the adoption by the United Nations General Assembly of the declaration on the rights of indigenous peoples and congratulates the Council and Member States for backing the adoption of that text, which will create a framework in which States can protect and promote the rights of indigenous people without exclusion or discrimination; at the same time, notes with concern that, without new instruments to guarantee the implementation of the declaration in question, real improvements in the life of indigenous peoples, especially those living under authoritarian and dictatorial regimes, cannot be expected; urges the Commission, therefore, to follow up on the implementation of the declaration, in particular through the European Instrument for Democracy and Human Rights (EIDHR), while in particular enjoining all the Member States to ratify as a matter of urgency International Labour Organization (ILO) Convention 169 on Indigenous and Tribal Peoples, which backs up the principles set out in the declaration in question with a legally binding instrument;
salue l'adoption par l'Assemblée générale des Nations unies d'une déclaration sur les droits des peuples indigènes et félicite le Conseil et les États membres du soutien qu'ils ont apporté à ce texte, lequel offre un cadre dans lequel les États pourront protéger et promouvoir les droits des peuples indigènes sans exclusion ni discrimination; relève toutefois avec préoccupation que, en l'absence de nouveaux instruments propres à garantir la mise en œuvre de cette déclaration, de réelles améliorations dans la vie des peuples indigènes, en particulier ceux qui vivent sous des régimes autoritaires ou dictatoriaux, ont peu de chances de se produire; prie dès lors instamment la Commission de suivre l'application de la déclaration, en particulier grâce à l'Instrument européen pour la démocratie et les Droits de l'homme (IEDDH), en particulier en recommandant la ratification urgente par tous les États membres de la Convention no 169 de l'Organisation internationale du travail (OIT) relative aux peuples indigènes et tribaux, qui renforce les principes décrits dans la déclaration mentionnée par un instrument légalement contraignant;

If consultation has already been initiated by a Member State and another Member State which is called upon to support the same transaction questions the first-mentioned State as to its final position, failure to reply to such questioning on the expiry of a period of five working days shall authorise the enquiring Member State to consider that the Member State thus questioned has supported the matter on the terms indicated during consultation.
Si une consultation a déjà été introduite par un État membre et qu'un autre État membre, appelé à donner son appui pour la même opération, interroge le premier sur sa position définitive, l'absence de réponse à une telle interrogation à l'expiration d'un délai de cinq jours ouvrables autorise l'État membre demandeur à considérer que l'État membre interrogé a appuyé l'affaire aux conditions signalées en consultation.

In particular, it is essential for the new political agenda to include other matters such as conflict prevention, reform of the United Nations system, the fight against terrorism, the promotion of democracy, human rights and the rule of law, environmental matters, questions concerning migration and cooperation in justice and home affairs etc.
En particulier, il est indispensable que le nouvel agenda politique inclut d'autres thèmes comme la prévention de conflits, la réforme du système des Nattions Unies; la lutte contre le terrorisme; la promotion de la démocratie, des droits de l'homme et de l'état de droit; les questions environnementales; les questions liées à la migration et à la coopération en matière d'affaires intérieures et de justice, etc.

3.7. If the Commission and the Member States in coordination meetings within the competent Council Working Party or on the spot cannot agree a common position, including for reasons of disagreement on the repartition of competence, with regard to questions referred to in points 3.6(a) and (b), the matter will be referred to the Permanent Representatives Committee which shall decide on the basis of the majority laid down in the relevant Community law dealing with the subject matter under consideration.
3.7. The Council failed to provide an answer to Question P-1690/99, forwarded on 17 September 1999, by 11 October 1999, the deadline set pursuant to Rule 44(5) of Parliament's Rules of Procedure. Given the extreme urgency surrounding the case in question, and the evident interest of the Council itself in the matter, as reflected in the call for a universal moratorium on executions which it is to submit to the United Nations Assembly with Parliament's explicit backing, can the Council provide the plenary sitting of the European Parliament with an answer to the said question, set out below, as a matter of urgency?
Comme suite à l’absence de réponses de la part du Conseil à la question écrite P-1690/99 (déposée le 17 septembre 1999 et qui aurait du faire l’objet d’une réponse le 11 octobre 1999 conformément aux dispositions de l’article 44, paragraphe 5 du règlement du Parlement européen), vu l’urgence extrême de l’affaire décrite et l’intérêt manifeste du Conseil formulé dans sa demande de moratoire universel sur les exécutions capitales qu’il présentera devant l’Assemblée des Nations unies et qui a fait l’objet de l’appui explicite du Parlement européen, nous réitérons notre question et prions instamment le Conseil à répondre en séance plénière du Parlement européen de toute urgence :

3.4. Equally, Article 43 of the EC Treaty does not provide a suitable framework for dealing with animal health or food quality matters - questions which can have major repercussions for the normal functioning of the internal market.
