The objective of market surveillance is to ensure that products covered by Community harmonisation legislation which, when used for their intended purpose or under conditions which can reasonably be foreseen and when properly installed and maintained, are liable to compromise the health or safety of users, or which otherwise do not conform to applicable requirements set out in Community harmonisation legislation, are withdrawn, prohibited or restricted from being made available on the market and that the public, the Commission and the other Member States are appropriately informed.

Where a Member State ascertains that a pyrotechnic article , bearing a CE marking, accompanied by the EC declaration of conformity and used in accordance with its intended purpose, is liable to compromise the health and safety of persons, it shall take all appropriate provisional measures to withdraw that article from the market, to prohibit its placing on the market or to restrict its free movement .

The notified body shall examine these modifications and shall then either confirm the validity of the existing EC type-examination certificate or issue a new one if the modifications are liable to compromise conformity with the essential health and safety requirements or the intended working conditions of the type.
