Thus, since the total cumulative sum of the daily rates for the lump-sum fine as at 16 October 2014 exceeds the minimum lump sum determined for Portugal, the Commission proposes that that Member State be required to pay the daily rate of the lump-sum fine, that is to say EUR 2 244 per day starting from the date of delivery of the Court’s judgment in Case C-530/07 and until the date of delivery of the judgment in accordance with Article 260 TFEU, or until the date on which the Portuguese Republic complies with the first of the Court’s judgments, if that date is earlier.

40 (1) Subject to subsection (3), an appeal lies to the Supreme Court from any final or other judgment of the Federal Court of Appeal or of the highest court of final resort in a province, or a judge thereof, in which judgment can be had in the particular case sought to be appealed to the Supreme Court, whether or not leave to appeal to the Supreme Court has been refused by any other court, where, with respect to the particular case sought to be appealed, the Supreme Court is of the opinion that any question involved therein is, by reason of its public importance or the importance of any issue of law or any issue of mixed law and fact involved in that question, one that ought to be decided by the Supreme Court or is, for any other reason, of such a nature or significance as to warrant decision by it, and leave to appeal from that judgment is accordingly granted by the Supreme Court.

(2) The Court may pronounce judgment in accordance with a notice filed under subsection (1) if the resultant judgment is one that could have been given on consent.

(2) Where it appears to a court that the omission or addition referred to in subsection (1) was an involuntary error and it is proved that the patentee is entitled to the remainder of his patent, the court shall render a judgment in accordance with the facts, and shall determine the costs, and the patent shall be held valid for that part of the invention described to which the patentee is so found to be entitled.

The Court of Justice accordingly sets aside the judgment of the Court of First Instance and refers the case back to that Court for judgment in accordance with this interpretation of Community law.

2. The action shall be brought before the Chamber of Appeal within two months of the date of notification of the judgment in accordance with the statute of the Community intellectual property court.
