The authentic act was defined by Community law in the Jenard-Möller Report on the Lugano Convention, a definition confirmed by the ECJ's Unibank judgment.

The Court [130] reiterates, citing the Jenard-Möller report on the Convention of Lugano, [131] that the conditions which had to be fulfilled by authentic instruments in order to be regarded as authentic are as follows: "the authenticity of the instrument should have been established by a public authority; this authenticity should relate to the content of the instrument and not only, for example, the signature; the instrument has to be enforceable in itself in the State in which it originates".
