Prima facie means “at first sight” or “on the face of it”. Maingot offers the following definition: “A prima facie case of privilege in the parliamentary sense is one where the evidence on its face as outlined by the Member is sufficiently strong for the House to be asked to debate the matter and to send it to a committee to investigate whether the privileges of the House have been breached or a contempt has occurred and report to the House” (2 ed., p. 221).

The second edition of Maingot's Parliamentary Privilege in Canada states, on page 42, that parliamentary privilege protects the member “when he speaks in Parliament, but when he speaks outside, or publishes outside what he says inside Parliament, Parliament offers no protection; only the common law does, if it is offered at all”.

Pour sa part, Maingot, dans la deuxième édition de son ouvrage Le Privilège parlementaire au Canada affirme, aux pages 43 et 44, que le privilège parlementaire protège le député « lorsqu'il parle devant [le Parlement], mais s'il répète ou publie à l'extérieur ce qu'il y a dit, le Parlement ne lui accorde aucune protection.
