On intelligence, Member States could increase their exchange of intelligence through the EU joint Situation Centre in particular on new threats not covered in the ESS, such as the security of energy supply and the security consequences of climate change.

The Treaty of Lisbon, for example, makes it very clear that the supervision of intelligence services in Member States’ territory is a Member State’s competence.

Where a Member State has obtained information or intelligence in accordance with this Framework Decision, and wishes to use it as evidence before a judicial authority, it has to obtain consent of the Member State that provided the information or intelligence, where necessary under the national law of the Member State that provided the information or intelligence, through the use of instruments regarding judicial cooperation in force between the Member States.

Where the information or intelligence sought has been obtained from another Member State or from a third country and is subject to the rule of speciality, its transmission to the competent law enforcement authority of another Member State may only take place with the consent of the Member State or third country that provided the information or intelligence.

2. The use of information and intelligence which has been exchanged directly or bilaterally under this Framework Decision shall be subject to the national data protection provisions of the receiving Member State, where the information and intelligence shall be subject to the same data protection rules as if they had been gathered in the receiving Member State.

In December 1999 in Helsinki the European Council decided to develop more effective European military capabilities with a view to undertaking the full range of Petersberg tasks in support of the CFSP. In order to achieve this goal, by the year 2003 the Union was to be able to rapidly deploy units of about 50 000 – 60 000 troops which should be self-sustaining, including the necessary command, strategic reconnaissance and intelligence capabilities. The first steps towards such an autonomous intelligence capability have already been taken in the framework of the WEU and the standing Political and Security Committee. Cooperation among intelligence services within the EU seems essential on the grounds that, firstly, a common security policy which did not involve the secret services would not make sense and, secondly, it would have numerous professional, financial and political advantages. It would also accord better with the idea of the EU as a partner on an equal footing with the United States and could bring together all the Member States in a system which complied fully with the ECHR.
