Calls on the Member States to fulfil their obligations to protect their citizens’ fundamental rights and civil liberties, to modify or delete those terms which limit the fundamental rights of the citizens, and urges Member States to honour their commitment and its deriving obligations made under the terms of the Lisbon Treaty for the EU to sign and ratify the European Convention on Human Rights, thus closing gaps in legal protection by giving European citizens the same rights vis-à-vis the acts of the Union as they presently enjoy vis-à-vis the Member States of the Union; recalls, in this context, the need for clear information regarding the scope and applicability of the Convention in relation to the Charter, in order to avoid confusion among citizens as to whom to address in a given situation of alleged fundamental rights breaches;
3. demande aux États membres de remplir leurs obligations en matière de protection des droits fondamentaux et des libertés civiles des citoyens, et de modifier ou de supprimer les dispositions qui restreignent les droits fondamentaux des citoyens; invite instamment les États membres à honorer l’engagement qu’ils ont pris en vertu du traité de Lisbonne et les obligations qui en découlent, à savoir que l’UE signe la convention européenne des droits de l’homme, ce qui comblerait des lacunes au niveau de la protection juridique, en donnant aux citoyens européens les mêmes droits face aux actes de l’Union que les droits dont ils jouissent actuellement vis-à-vis des États membres; rappelle à cet égard la nécessité d’une information claire quant à la portée et à l’applicabilité de la convention en relation avec la charte, afin d’éviter toute confusion dans l’esprit des citoyens au moment de déterminer à qui s’adresser dans une situation donnée de violation présumée des droits fondamentaux;

12. Calls for international agreements, country strategy papers, action plans, the GSP+ programme and all other contractual relations between the Union and third countries to be tightened up by means of more clearly worded clauses on human rights, democracy, the right of indigenous peoples to be consulted before decisions are taken, good governance, specific mechanisms in the event of non-compliance (based, at the very least, on those set out in the Cotonou Agreement), commitments coupled with specific, measurable, achievable, time-bound criteria for assessing the progress made, and a specific timetable for implementation; regrets that despite the human rights clauses in the Cotonou Agreement, the EU often turns a blind eye to continuing systematic human rights violations committed by some Cotonou partner governments, adopting a ‘business as usual’ relationship; calls on the Commission to adopt consistent policies aimed at discouraging human rights violations, such as reducing the financial envelopes for governments that fail to respect democracy and human rights, thus denying them budget support, while increasing financial resources to strengthen civil society which bypass those governments;
12. recommande que les accords internationaux, les documents de stratégie par pays, les plans d'action, le programme SPG+ et toute autre relation contractuelle entre l'Union et un pays tiers soient renforcés par une formulation plus précise des clauses sur les droits de l'homme, la démocratie, le droit des peuples indigènes à une consultation préalable, la bonne gouvernance, des mécanismes spécifiques en cas de non-respect (sur la base, a minima, de ceux contenus dans l'accord de Cotonou), d'engagements liés à des critères de mesure spécifiques, mesurables, réalisables et assortis de délais afin d'évaluer les progrès réalisés, et un calendrier de mise en œuvre précis; déplore le fait que, en dépit des clauses relatives aux droits de l'homme contenues dans l'accord de Cotonou, l'Union européenne ferme souvent les yeux sur les violations des droits de l'homme continues et systématiques commises par certains gouvernements de pays partenaires de Cotonou, se contentant de maintenir «le cours normal des affaires»; demande à la Commission d'adopter des politiques cohérentes tendant à décourager les violations des droits de l'homme, telles que la réduction des enveloppes financières allouées aux gouvernements ne respectant pas la démocratie et les droits de l'homme, en leur refusant donc toute aide financière, tout en augmentant les ressources financières consacrées au renforcement de la société civile, afin de contourner ces gouvernements;

1. The International Criminal Court (hereinafter the ‘ICC’), for the purpose of preventing and curbing the commission of the serious crimes falling within its jurisdiction, is an essential means of promoting respect for international humanitarian law and human rights, thus contributing to freedom, security, justice and the rule of law as well as contributing to the preservation of peace, the prevention of conflicts and the strengthening of international security, in accordance with the purposes and principles of the Charter of the United Nations.

La Cour pénale internationale (ci-après dénommée «CPI») constitue, aux fins de prévenir et de limiter la commission des crimes graves relevant de sa compétence, un moyen essentiel pour promouvoir le respect du droit humanitaire international et des droits de l'homme, contribuant ainsi à la liberté, à la sécurité, à la justice et à l'État de droit, ainsi qu'au maintien de la paix, à la prévention des conflits et au renforcement de la sécurité internationale, conformément aux buts et principes de la charte des Nations unies.

The Human Rights Council is a forum of particular importance, both concretely and symbolically, in the context of creating a means of dealing with a situation which, in the worst-case scenario, could result in a serious undermining of the credibility of the universal concept of human rights, thus sapping the effectiveness of international actions for the promotion and defence of that concept.

The German constitutional court found that the rules governing access to and the use of the data, as laid down in national law, were unconstitutional.[43] The Romanian constitutional court found that data retention per se breached Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms (European Convention on Human Rights) and was thus unconstitutional.[44] The Commission is currently evaluating this instrument and is to submit its assessment report to the European Parliament and the Council in late 2010.
